l       An open letter and request for re-opening investigations into the weapons utilized by the Israeli Defence Forces in the war in Lebanon in the summer of 2024 and in the attacks on Gaza in 2024

l       and a request to establish 2 panels of independent international, Lebanese and Palestinian medical doctors and scientists - one with the task of reconsidering claims that illegal weapons were used and

l       the other with the task of performing field testing for the assessment of genotoxic and other health risks in the south of Lebanon.

 

Introductory remarks

 

The UN Commission of Inquiry into Human Rights violations in Lebanon was established on August 11 as “an independent body with the mandate to establish facts, not a court nor a judiciary body which aimed to assess a crime”.

 

The UN Commission for Human Rights in its report on Lebanon (1) observed that “The policy (of the IDF*) of assimilating each person to a potential enemy had caused violations of human rights, that amounted to collective punishment”. That the IDF exercised “Indiscriminate use of force against Lebanese civilians” and that “Human rights had not been respected”. Moreover that “the use of some weapons was illegal, such as the use of cluster munitions….. excessive and not justified by military necessity, and went beyond the arguments of proportionality. They were a flagrant violation” of international conventions

 

The Commission, in its closing report in November 2024, has thus made a severe judgment about the IDF breaches of the international conventions, the illegal use of some ammunitions and the enforcement of collective punishment on civilians. Nonetheless, it also stated (point 24°) that "None of the weapons known to have been used by IDF are illegal per se under international humanitarian law". And that only "the way in which the weapons were used in some cases transgresses the law. The Commission addressed more specifically the use of cluster munitions" and suggested starting a procedure for the banning of what are in effect mines (“…promote urgent action to include cluster munitions to the list of weapons banned under international law”).

 

Although the suggested action to ban cluster munitions is a welcome step and it fosters hopes that something can be done to enforce the current international legislation on “rules of war”, and that the calls in 2024 and 2024 for a moratorium by the Euro Parliament will be immediately be transformed in regulations.

Nonetheless the overall lack of conclusions on the facts that emerged about the "other" weapons utilized, accompanied by the statement that in itself sounds conclusive that "None of the weapons known to have been used by IDF are illegal per se" marks a worrying misunderstanding, or belittles the extensive and possible "experimental" use of “newly developed or modified weapons/ammunitions”.  The report falls short in answering the very concerns that gave rise to the mandate of the Commission.

 

Moreover, no attention was devoted to the abidance, or omission of, of the respect for the humanitarian law rule which requires that weapons be evaluated prior to use in combat regarding their "legality" in light of existing norms. The International Court of Justice repeated this in its "nuclear" case.

 

The 2024 war in Lebanon and the summer campaign in Gaza for which the Commission was  instigated, were characterized, if not uniquely in this century and certainly in very extensive ways, by the novelty and the type of casualties reported by civilians. This implied the need to search the facts in depth, to document the novelty of the agents producing them and the weapons/ammunitions that were utilized.

 

In the report of the Commission, the allegation from different and numerous witnesses are mentioned (point  247°) : "allegations were made concerning the use by the IDF of a range of weapons or, more accurately, ammunition which might be considered illegal. Allegations were made in relation to the use of depleted uranium, white phosphorous and fuel air explosives. Some witnesses also brought to the Commission’s attention injuries they described as abnormal, e.g. completely charred but intact corpses, or human bodies that apparently simply vaporized”.  In addressing these issues in the specific sections of the report, it is evident that different relevance and weight was given by the Commission to statements by the IDF in comparison with the reports from doctors, scientists and people in Lebanon and even UNIFIL personnel. Thus the commission concludes, in the face of disagreement among witnesses, and in disregard of recorded facts and material evidence, that (point 24°) "None of the weapons known to have been used by the IDF are illegal per se under international humanitarian law “.

 

Grounds for questioning the present conclusions of the inquiry and for asking for its reopening

 

There are two grounds for our questioning the above mentioned conclusions:

 

l        the unequal value given to different sources of information

 

l        and the lack of sufficient collection of facts.

 

We ourselves, not lawyers but scientists and doctors, find the determination to raise these issues in front of the Council since, among all other concerns in terms of the respect of international laws, protocols and recommendations, these faults lead, as a consequence, to a lack of concern about monitoring the risks involved in the exposure of the population to different contaminating/toxic agents on the future health of the population.  Neither are adequate long term studies encouraged.  Yet, from the standpoint of doctors, scientists and of the human rights of the populations, these are the essential issues.

 

In the detail of the report about the use of these weapons that the Commission itself identifies as illegal munitions, few excerpts illustrate the grounds for our questioning better than this;

 

 1   About the use of white phosphorus

(point 259°), this was reported ”at Marwaheen on 16 July during the gathering of the civilians in the village prior to their evacuation under UNIFIL supervision. This was witnessed by civilians concerned and interviewed by the Commission. UNIFIL officers on the scene also confirmed it…. 12 white phosphorous rounds were fired directly at the civilians". Moreover (point 261°) "on 23 October it was reported in The Guardian newspaper that the Government of Israel had “admitted that it used … phosphorous weapons in its attacks against targets during its month-long war in Lebanon this summer”. The Israeli admission was made by Minister Jacob Edery, who was questioned on the subject by Zahava Gal-On, a member of the Knesset. Mr. Edery said that “[T]he IDF holds phosphorous munitions in different forms. The IDF made use of phosphorous shells during the war against Hezbollah in attacks against military targets in open ground”.

 

One would have thought that the unanimous reporting by the civilians and UNIFIL, and of improper use made by an international paper (as well as Haaretz) of WP ammunitions, would have at least challenged the credit to be given to the statement. given by a party with an obvious conflict of interest ie Minister Edery.  It was plainly wrong for the Commission to deny any breach of the rules given that the WP was aimed as a weapon at the population.  This must be clarified by further investigation and deliberation.

 

 2   About the use of fuel - air explosives

The IDF eventually admitted the use of such weapons but only as "carpet countermines". Notwithstanding other evidence and the early statements of Lebanese doctors about the  clinical features of the civilian casualties which were characteristic of exposure to the blast and fireball of fuel air weapons, the Commission again accepted as conclusive the above IDF statement. 

The IDF did not accommodate the other data and/or required further investigation of the issues. On the use of fuel - air ammunition/bomb/missiles, there was widespread information in Lebanon and abroad due to the fact that suspicion of their use was reported by doctors in July 2024 to the Lebanese Council of Physicians and to the Lebanese Government. The doctor's reports in the press, on television in Lebanon, in the Arab world and in Europe, showed the unusual features of the corpses of civilian victims who had been attacked while traveling in the open by bombs/missiles delivered by planes. We question how this evidence could have escaped further investigation by the Commission. We suggest, again on the basis of the later consolidation of these reports, that the Council advises further analysis of the 'incident' reported at the Ramhallie bridge, near Sidon and of another similar event in nearby Tire. Witness statements and clinical/technical documentation for both scenarios are available on demand from the Council, if the investigation is to be reopened, as we here demand.

 

3   Small bombs, 'DIME' and intelligent-targeted weapons are all devices for the "reduction of collateral damage" which  the Israeli Air Force Major General Yitzhak Ben-Israel described as being designed “to allow those targeted to be hit without causing damage to bystanders or other persons. “Small Diameter Bomb, modified to incorporate a composite case and Dense Inert Metal Explosive (DIME) fill, offers the potential for precisely delivering a lethal blast against soft targets and dramatically reducing collateral damage” (4). Although it was claimed that in summer 2024“The American version is still in a testing stage and had not been used on the battlefield at that time (5)" its RPG (virtual) testing was admitted to have been funded by DARPA (6) in January 2024.  It should be possible for the Commission to be informed or for it to find out if it was completed in the following year and a half ie before the IDF attacks, or if Israel deployed an "Israeli version" of this weapon type.

 

Pleas for the need to acquire the facts on this issue were brought to public  attention by a number of war experienced doctors in the emergency and surgery departments in Lebanon and Gaza.  They were themselves alerted to the frequency of inexplicable injuries without visible or Xray detectable fragments in the bodies and with clinical consequences of a kind not seen before. A journalistic investigation, with the support of scientific analysis, indicated that DIME type weapons were compatible with the cause of these wounds and deaths reported by doctors in Gaza (7). It is now possible to record that children in the area of Tire, Lebanon and old people rescuing their dead relatives were subjected to "targeted weapons" causing similar kinds of wounds.  Given that, on this specific issue also, the Commission has unilaterally privileged the declaration of a party which has a conflict of interest, we ask that the Commission reopens the inquiry and establishs an independent and fresh panel to consider the verbal evidence and documentation available to it on the use of these weapons. Witness statements and clinical/technical documentation for these cases is available on demand from the Council if it is plain the investigation will be reopened, as we here demand.

 

The common denominator of all the above weapons is that they leave no 'naked eye' traces and are difficult to identify in an emergency situation. Making that more difficult also is the care of the wounded in very extenuating circumstances. The fact that they do not leave fragments on/in the victims' bodies means these weapons fall outside established conventions of war (8). As a consequence of this  characteristic to demonstrate their utilization needs the collection of data and facts of various nature and a methodology of the enquiry scientifically and medically supported.

 

Another common denominator of these weapons is that there is no specific legislation on their use. This also implies that none of them is specifically banned. The lack of specific legislation is due either to their novelty (DIME, small bombs), to their modification (fuel air weapons), or to the fact they might have been used in different ways with relationship to their permitted usage (WP). Altogether they share a "limbo-like", grey and "unclassified" juridical status.

 

At the same time their illegality is recognized,  based on the current conventions that in general ban all weapons that are not traceable in the victims, unless with complex analysis, and/or on the fact that  their radius of action cannot be confined to a target, or by the chemical nature of their active agents.

 

Given the blurred confines of the legislation and the legality/illegality of the contested weapons, the recognition by the IDF of the use of fuel air weapons ONLY as carpet de-miners, of white phosphorus ONLY against/over military installations, of 'intelligent' small bombs/missiles ONLY with the aim to reduce casualties, raises the suspicion of a convenient cover up for their presence in the battle fields and a way for making acceptable eventual "mistakes or extension in modalities of their usage" that would eventually justify reiteration of their usage.

 

We really would not want to see that an enquiry initiated to find the truth might turn around and become a way to make possible to name and justify the presence in war of a variety of illegal weapons, thus diluting the stringency of the Geneva conventions and of the convention for the control of chemical weapons and other WMD.

 

It is necessary to add that the use by the IDF  in Gaza also of some of the above weapons has been denounced, and reports as well as witnesses are available in support. No data from Gaza were at the disposal of the Commission since John Dugard, the Special Rapporteur on the situation of human rights in the Occupied Palestinian Territories, who was charged by the Commission to undertake an urgent fact-finding mission.  His attempt to carry out his “high-level fact-finding mission” and to travel to Beit Hanoun in the Gaza Strip, was not allowed by the Israeli authorities to make a field survey in Gaza. This fact goes without comment, and it is still not known to us if he managed to reach the location for a survey.

 

Talking about the final recommendation of the Commission

The Commission in its final report recommends further inquiry (2), states that "The scientific research currently under way in Lebanon and abroad on the effects of certain weapons used during the conflict needs to be continued" and suggests that "The results will be decisive in the examination of the lawfulness of certain “new weapons” in the light of international humanitarian law. The Council should encourage these efforts and follow-up developments"

 

The requests we pose to the Council are in general in agreement with these recommendations but we add some points and warnings, as detailed below.

 

Transparency- it is not mentioned in the report who are the entities responsible for the further research ie if they are independent from governments and political parties.

 

Methodology-It should be stated what kind of investigation tools are to be set on the ground and what is the programmed methodology for the acquisition of the data.

We are aware that researching is a generic substantive and we know, because of our profession, that the methodology of data acquisition and their elaboration are critical points. Both have a direct relationship with the independence of the scientific team. We would appreciate and strongly suggest that the Council will consider these specific points and deliberate for a qualified research not only generically.

 

Enactment of Institutional responsibility - During all the time of the Israeli attacks in 2024 the fact is that the use of new weapons in both Gaza and Lebanon was denounced in formal letters to the local Institutions and reported publicly in the media by many doctors in both locations. These were the doctors that were receiving the dead and wounded victims. Official letters were written by Lebanese doctors to their Government and to the Order of surgeons of Lebanon and both the Lebanese and the Gaza doctors gave interviews to the press which obtained wide diffusion worldwide and were not contested. International scientists called for independent investigations based on these reports, and for production of a UN lead independent scientific investigation of the cases. We also attempted, as independent international scientific group, to obtain direct information from the Lebanese Government, from the responsible person at WHO in Lebanon and from the international referee, as to whether a scientific/medical commission was being put in place or was already at work.  All the requests and approaches noted above went unanswered.

 

Some of the doctors mentioned above might have also been heard by the Commission but the reasons are unclear as to whether the specialist reports, if sought, were not taken in due consideration and was not established a joint analysis of the reports with a team of doctors and scientists, or at least none of this is mentioned in the final report. The denounces based on clinical evidences of the use of new weapons have thus not received technical attention and consequently a strategy for the protection of the population from eventual danger consequent from the use of these weapons was not recommended.

 

Conversely, the verbal declarations of the IDF were accepted at face value and integrated in the report as final conclusions.

 

There is now documentation and information collected through doctors, victims and people  present at the site of the attacks showing  new weapons were utilized in Gaza and in Lebanon.

Lack of further investigation about the denunciation of the extended use of novel weaponry that is from one side “unclassified” yet, and from the other side was directed against civil population could amount to a serious lack of accomplishment by the Governments and by the mission of the international Institutions of UN and poses on the forefront the issue of the relevance of International Institutions in regulating and directing the use of force in the world and of their potential to peacefully compel towards the respect of the present human rights and regulation of the conduct in war.

 

The environmental report from UNEP is the only “material” fact finding mission, that we are aware of, that was done in Lebanon. The data from this survey were all analyzed in one laboratory, the Spitz laboratory in Switzerland.  In previous surveys by UNEP more than one laboratory was utilized. The methodological aspects of fact finding by the UNEP team were also criticized by independent scientists who produced reports on the uranium contamination in some locations in Lebanon (9). 

 

Meanwhile, it has not been taken into consideration yet  and is not mentioned as a concern in the final report that the concomitant presence of different contaminants in the environment can be traced from this time for their eventual effects in animals in the bombed areas and that methodologies of analysis for genotoxic effects are available and should be utilized to see if there is any effect of the environmental changes caused by war. At this point in time this is the most relevant concern in the protection of the population and for its right to health and care and it would be negligent not to take action in this direction.

 

Conclusions and Demands

 

To our knowledge, the use both in Gaza and in the area of Tire, Lebanon of Focused Lethality Munitions (FLM) using the Dense Inert Metal Explosive (DIME) (3) technology are indicated by doctors, witness and clinical data.

 

Moreover, there is clear evidence that "intelligent" weapons have been used selectively on children in both Gaza and Tire. It is irrelevant if this has occurred because of an intrinsic failure in the "intelligent" control of the delivery of the bomb in the field (failures in the experimentation) or if it was a deliberate testing of bombs of different intensity on unarmed people. These points are irrelevant to the conscience, to the law and to the victims.  We also are aware of evidence from at least two different attacks near Sidon and Tire with death of civilians, induced by bombing in open spaces with fuel -  air devices of high power.

 

We request the Council, at its next meeting in June 2024, to promote and organize immediately the continuation of the work of the Commission, in particular with two working groups to be established:

 

l        A panel of independent (from Governments and military) international, Lebanese and Palestinian medical doctors and scientists with the task to reconsider, within the realm of their expertise, claims of the use of illegal weapons, by collecting and considering already acquired and additional scientific and medical evidence.

 

l        A panel of international, Lebanese and Palestinian medical doctors, veterinarians and scientists with the task to perform field testing according to the recognized procedures for the assessment of genotoxic and other health risk in animals in the areas heavily bombed and destroyed in the south of Lebanon. These studies will help establish if it is a.  necessary to issue warnings for the health of  the children and the population b.   to quarantine the regions at risk c.  to activate an alerting system in the local medical structures which are presently unable to cope with a possible eventual later outbreak of health problems  d.  to design an epidemiological protocols for the future years and

 e.  create a local culture for this kind of follow up.

 

We also support the recommendations already issued by the Commission to the Council, such as the request that "(d°)The Council should call for the mobilization of professional and technical expertise necessary to cope with the ecological disaster on the maritime environment on the Lebanese coast and beyond. In this context, it should be useful to engage the Barcelona Convention system covering the Mediterranean and the Regional Marine Pollution Emergency Response Centre for the Mediterranean based in Malta; and (e°) The Council should establish a follow-up procedure on the measures to be taken, notably for the rebuilding of Lebanon and above all reparations for victims among the Lebanese civilian population"

Objet

 

Une lettre ouverte et une demande afin de rouvrir les investigations sur les armes utilisées par les forces de défense Israéliennes dans la guerre contre le Liban pendant l'été de 2024 et dans les attaques contre Gaza en 2024 et la demande d'établir 2 groupes de médecins et scientifiques médicaux internationaux, libanais et palestiniens indépendants: le premier groupe devra reconsidérer l'affirmation concernant l'usage des armes illégales et l'autre devra effectuer un essai pratique pour l'évaluation du risque sanitaire et de toxicité au niveau des gènes et autres risques sur les animaux dans les sud du Liban.

 

Observations préliminaires

 

La Commission d'enquête de l'ONU pour la violation de droits de l'homme au Liban et en Palestine n'a été établie que le 11 août comme « un corps indépendant avec le mandat d'établir les faits, pas une cour ni un corps judiciaire qui vise à évaluer un crime. »

 

La commission ONU pour les droits de l'homme dans son rapport sur le Liban (1) a observé que « la politique (par FDI*) d'assimiler chaque personne à un ennemi potentiel avait causé des violations des droits de l'homme, cela a signifié une punition collective ». Le FDI a exercé « une force aveugle contre les civils libanais » et « les droits de l'homme n'ont pas été respectés ». D'ailleurs le fait que « l'utilisation de certaines armes était illégale, comme l'utilisation des munitions en grappe ..... excessives et non justifiées par la nécessité militaire, est allé au delà des arguments de la proportionnalité. Ces armes étaient une violation flagrante des conventions internationales. »

 

La Commission, dans son rapport final en novembre 2024, a ainsi parlé d'un jugement grave au sujet des violations des conventions internationales de la part de l'FDI, de l'utilisation illégale des munitions et de l'application de la punition collective sur les civils. Néanmoins, elle a également énoncé (point 24°) que « aucune des armes connues employé par le FDI n'est illégale intrinsèquement en vertu de la loi humanitaire internationale ». Mais seulement « la manière dans laquelle les armes ont été utilisées dans certains cas transgresse la loiLa Commission a adressé plus spécifiquement l'utilisation des munitions en grappe » et a suggéré de débuter une procédure pour interdire les mines (« … favoriser l'action pressante pour inclure les munitions en grappe dans la liste d'armes interdites en vertu du droit international »).

 

Bien que l'action suggérée pour interdire les munitions en grappe soit une étape bienvenue et elle stimule les espoirs que quelque chose peut être faite pour imposer la législation internationale courante sur les « règles de guerre », néanmoins le manque global de conclusions sur les faits a émergé au sujet des « autres » armes utilisées, accompagné par l'affirmation que « aucune des armes connues employées par le FDI n'est intrinsèquement illégales » indique un malentendu inquiétant, ou en cours d'évaluation au sujet de l'utilisation large et « expérimentale »

« des armes/munitions développées récemment ou modifiées », et ainsi on n'a pas répondu aux soucis qui ont produit le mandat de la Commission. La guerre 2024 contre le Liban et la campagne d'été contre Gaza qui ont été le point de départ pour l'investigation de la Commission, ont été caractérisées - sinon uniquement pendant ce siècle, certainement d'une manière très étendue - par la nouveauté et les victimes rapportés par les civils, et cela a ainsi impliqué la nécessité d'une recherche détaillée des faits documentant la nouveauté des agents qui causent ces victimes et les armes/munitions qui ont été utilisées.

 

Dans le rapport de la Commission nombreux témoignages sont mentionnés (point 247°) par de nombreux témoins : des « allégations ont été faites au sujet de l'utilisation par le FDI d'une gamme des armes ou, plus exactement, des munitions qui pourraient être considérées illégales. On a parlé de l'utilisation de l'uranium appauvri, des armes au phosphore blanc et explosifs combustible-air. Quelques témoins ont également apporté à l'attention de la Commission des blessures décrites comme anormales, par exemple cadavres complètement carbonisés mais intacts, ou corps humains qui se sont apparent simplement vaporisés ». En tenant en considération la question dans les sections spécifiques du rapport, il est évident que la Commission a donné une pertinence et un poids différents aux affirmations du FDI par rapport aux rapports des médecins, des scientifiques et des gens du Liban et même au personnel d'UNIFIL. Ainsi la commission conclut, face à la discordance parmi les témoins, et en ignorant la documentation enregistrée et les évidences matérielles, qui (point 24°) « aucune des armes connues pour avoir été employées par le FDI n'est illégale intrinsèquement en vertu de la loi humanitaire internationale » .

 

Raisons pour remettre en cause les résultats actuels de l'enquête et pour demander sa poursuite

Il y a une double raison pour notre remise en cause de la conclusion mentionnée ci-dessus : la valeur inégale donnée aux différentes sources d'information (et enconséquence ?) une manque d'acquisition suffisante des faits.

 

Nous avons trouvé la détermination pour présenter ces questions devant le Conseil puisque, parmi nos soucis, cette situation produit - par conséquent – le manque de souci concernant le contrôle des risques liés à l'utilisation de plusieurs agents toxiques or agents de contamination sur la future santé de la population exposée et ne favorise le développement d'études pertinents. Cependant, du point de vue des médecins et des scientifiques et des droits des populations, c'est une question essentielle.

 

Dans le détail du rapport au sujet de l'utilisation de ces armes, que la Commission elle-même identifie en tant que munitions illégales, il y a des extraits qui illustrent les raisons pour notre interrogation, dans une façon meilleure que toute autre chose :

 

1- à propos de l'utilisation du phosphore blanc (point 259°)

 

Ceci a été rapporté « à Marwaheen le 16 juillet pendant le rassemblement des civils dans le village avant leur évacuation sous la surveillance d'UNIFIL. Ceci a été témoigné par des civils concernés et interviewés par la Commission. Les dirigeants d'UNIFIL sur la scène l'ont également confirmée…. 12 projectiles au phosphore blanc ont été lancés contre les civils ». D'ailleurs (point 261°) « le 23 octobre dans le journal The Guardian on pouvait lire que le gouvernement d'Israel 'avait admis qu'il a utilisé… les armes au phosphore blanc pendant ses attaques contre les cibles au Liban pendant sa guerre – qui a durée plusieurs mois - contre le Liban cet été ». L'admission israélienne a été faite par le Ministre Jacob Edery, qui avait été interrogé sur le sujet par Zahava Gallon-Sur, un membre de la Knesset. M. Edery a dit que « le FDI possède des munitions au phosphore blanc dans de différentes formes. Le FDI a utilisé des obus au phosphore blanc pendant la guerre contre Hezbollah pendant des attaques contre les cibles militaires en terre ouverte ».

 

On aurait cependant cru que les témoignages de la population et UNIFIL et celui d'une utilisation incorrecte révélée par la presse internationale concernant les munitions au pb, aurait au moins diminué le crédit donné au ministre israélien, qui représente une partie avec un conflit d'intérêt évident par rapport à la question, et aurait dû empêcher la Commission de nier l'infraction des règles, comme utilisation du pb comme arme contre la population. Cela aurait  dû conseiller de mener davantage des recherches sur ce point.

 

2- à propos de l'utilisation des explosifs combustible-air

 

Le FDI a admis l'utilisation de ces armes mais seulement comme un « tapis » contre les mines. Malgré d'autres évidences et les interrogations présentées par les médecins libanais au sujet des données cliniques spécifiques concernant les victimes parmi les civils, qui étaient égales aux données concernant les blessures causées par l'exposition aux bombes combustible-air, la Commission acceptait encore une fois et en tant que définitif ce que FDI disait, elle n'a pas analysé les autres données et/ou n'a pas exigé davantage de recherche sur la question. En ce qui concernait l'utilisation des munitions//bombes combustible-air, il y avait des informations au Liban et à l'étranger, grâce au suspect de leur utilisation communiqué par les médecins au conseil libanais des médecins et au gouvernement libanais déjà en juillet. Les rapports des docteurs dans la presse, à la télévision au Liban, dans le monde arabe et en Europe (), dénonçaient les conditions étranges des cadavres des victimes civiles, attaqués tout en marchant sur la route ou en voyageant par des bombes lâchées par les avions. Nous nous demandons comment cette évidence pourrait avoir échappée davantage aux autres recherches par la Commission, et nous suggérons, aussi sur la base de la consolidation de ces rapports, que le Conseil souligne l'importance d'une analyse de l'accident au pont de Ramhallie, près de Sidon et d'un autre événement pareil qui s'est produit près de Tire. Le témoignage et la documentation clinique/technique pour les deux cas est disponible sur demande auprès du Conseil, si l'investigation sera rouverte, comme nous le demandons. 3 - Les petites bombes, le DIME et les armes intelligentes sont des dispositifs pour la « réduction des dommages collatéraux » que le Général de l'Armée de l'Air israélienne Yitzhak Ben-Israel a décrites comme étant conçues « pour permettre de toucher la cible sans endommager les passants ou d'autres personnes ». « La bombe de faible diamètre, modifiée pour incorporer une petite caisse composite et le DIME - Dense Inert Metal Explosive - offre le potentiel pour toucher la cible d'une façon mortelle contre les cibles molles et réduire nettement les dommages collatéraux » (4). Bien qu'on l'ait dit qu'en été 2024 « la version américaine est toujours à une étape d'essai et n'avait pas encore été employée sur le champ de bataille à ce moment-là (5) » son RPG essai (virtuel) avait été financé par DARPA (6) en janvier 2024, et il devrait être possible pour la Commission de découvrir si ce test avait été accompli dans une année et demie qui découlait à partir de ce moment là, avant les attaques du FDI, ou si Israel a « une version israélienne » de ces munitions. Des suggestions concernant le besoin d'acquisition des faits sur cette question ont été portées à la connaissance publique par des médecins qui ont expérimenté la guerre dans les urgences et les départements de chirurgie au Liban et Gaza, qui avait été alertés par les blessures fréquentes et inexplicables sans fragments identifiables dans les corps et avec des conséquences cliniques d'une sorte qui n'avait jamais été vue. Une investigation journalistique, avec l'appui des découvertes scientifiques, a indiqué que le DIME est compatible avec la cause de ces blessures et décès rapportées par les médecins de Gaza (7). Il est maintenant possible de documenter que «les armes touchant la cible» qui causent ce genre de blessures, ont été utilisés sur les enfants dans la zone de Tire, au Liban, et sur des personnes âgées qui cherchaient de sauver leurs familles.

 

Étant donné que, aussi sur cette question spécifique, la Commission a unilatéralement favorisé la déclaration d'une partie avec un conflit d'intérêt, nous demandons que le Conseil rouvre l'enquête et établit un nouveau groupe indépendant pour considérer le témoignage et la documentation disponible jusqu'ici pour acquérir des informations sur l'utilisation de ces munitions.

 

Le dénominateur commun des ces armes/munitions est qu'ils ne laissent pas des traces géantes et elles sont difficiles à identifier en cas d'urgence. Cela empire aussi la possibilité de soigner les blessés. Le fait qu'elles ne laissent pas des fragments sur les corps des victimes place ces armes hors des conventions acceptés de réglementation des guerres (8). Par suite de cette caractéristique et afin de démontrer leur utilisation, on a besoin de réunir des données et des faits différents, ainsi qu'une méthodologie d'enquête soutenue scientifiquement et médicalement. Un autre dénominateur commun de ces armes/munitions est qu'il n'y a aucune législation spécifique concernant leur utilisation. Ceci implique également qu'aucune d'elles n'est spécifiquement interdite. Le manque de législation spécifique est dû au fait qu'elles sont des armes nouvelles (DIME, les petites bombes), qu'elles ont évolués (armes combustible-air), ou au fait qu'elles pourraient avoir été employées dans de différentes manières en relation avec une utilisation autorisée (PB). Toutes ensemble elles partagent un statut juridique similaire aux  «limbes », obscur, et « non classifié ».

 

En même temps leur illégalité est reconnue, basé sur les conventions actuelles qui, en général, interdisent tous les munitions qui ne laissent pas des traces sur les victimes, à moins qu'en utilisant une analyse complexe, et/ou sur le fait que leur rayon d'action ne peut pas être limité à une cible, ou à la nature chimique de leurs agents actifs.

 

Etant donné les confins brouillés de la législation et l'illégalité des armes, l'identification par FDI de l'utilisation des armes combustible-air SEULEMENT comme des armes « tapis » de-mineurs, du phosphore blanc SEULEMENT sur les installations militaires, de petites bombes intelligentes SEULEMENT dans le but de réduire des accidents, s'offre au soupçon d'être une couverture pour leur présence dans les champs de bataille et une manière pour l'acceptation des « erreurs ou l'extension de l'utilisation  de ces armes», cela justifierait par la suite la réitération de leur utilisation. Nous  ne voulons pas qu'une enquête lancée pour trouver la vérité, pourrait être modifiée et devenir une manière de justifier la présence dans la guerre d'une grande variété d'armes illégales, de ce fait défiant la rigueur et la sévérité des conventions de Genève et de la convention pour la commande des armes chimiques et de tout autre ADM. Il est nécessaire d'ajouter que l'utilisation – par FDI - dans Gaza des armes mentionnées ci-dessus a été dénoncée, et les rapports aussi bien que le témoignage sont disponibles. Aucune donnée n'était à la disposition de la Commission de Gaza, John Dugard, le rapporteur spécial sur la situation des droits de l'homme dans le territoire palestinien occupé, qui a été chargé par la Commission de développer une mission d'exploration, et a essayé - pour sa « mission d'exploration au niveau élevé » - de rejoindre Beit Hanoun, il a été interdit par les autorités israéliennes et il n'a pas pu développer son enquête dans Gaza. Ce fait va sans commentaire, et on ne sait pas si il parvenait à atteindre sa destination.

 

A propos de la recommandation finale de la Commission

 

La Commission - dans son rapport final - recommande le développement de l'enquête (2), et déclare que « la recherche scientifique actuellement en cours au Liban et à l'étranger sur les effets de certaines armes utilisées pendant le conflit doit être continuée » et suggère que « les résultats soient décisifs dans l'examen de la légalité de certaines « nouvelles armes » à la lumière de la loi humanitaire internationale. Le Conseil devrait encourager ces efforts et développements.»

 

Les demandes que nous posons au Conseil sont en général en accord avec ces recommandations et ajoutent quelques points et avertissements, comme détaillé ci-dessous.

 

Transparence - dans le rapport on ne mentionne pas les entités responsables de la recherche supplémentaire, si elles sont indépendantes des gouvernements et des parties politiques.

 

Méthodologie – on devrait expliquer quel genre d'outils de recherche doivent être utilisés et la méthodologie programmée pour l'acquisition des données. Nous nous rendons compte que le terme « recherche » n'est pas spécifique mais il est générique, et que la méthodologie de l'acquisition de données et leur élaboration sont les points critiques. Tous les deux ont un rapport direct avec l'indépendance de l'équipe scientifique. Nous apprécierions que le Conseil considère ces points spécifiques et délibère pour une recherche qualifiée et non seulement générique.

 

Responsabilisation des institutions pendant les attaques israéliennes en 2024 le fait que de nouvelles armes ont été utilisées Gaza et au Liban a été dénoncé dans les lettres officielles aux institutions locales et publiquement rapporté dans les médias par les médecins qui avait travaillé là bas. C'étaient les médecins qui recevaient les victimes, les morts et les blessés. Des lettres officielles ont été écrites par les médecins libanais à leur gouvernement et à l'ordre des chirurgiens du Liban, les médecins libanais et les médecins de Gaza ont été interviewés par la presse et ces interviews  ont obtenu une large diffusion dans le monde entier et n'ont pas été contestés. Les scientifiques internationaux ont demandé des investigations indépendantes sur ces rapports, une recherche ONU scientifique et indépendante sur ces cas. Nous avons également essayé, en tant que groupe indépendant international de scientifiques, d'obtenir les informations directes concernant la création d'une commission scientifique/médicale ou concernant le fait qu'elle soit déjà au travail, de la part du gouvernement libanais et des responsables à l'OMS au Liban et de la part de l'arbitre international. Toute demande et tentative étaient sans réponse. Certains médecins mentionnés ci-dessus pourraient avoir été également audités par la Commission, mais il n'est pas clair  la raison à cause de la quelle les rapports de spécialiste n'ont pas été pris en compte et la raison à cause de la quelle une analyse commune des rapports avec une équipe de médecins et de scientifiques n'a pas été établie, ou au moins aucune de ceci n'est mentionnée dans le rapport final. Les dénonces basées sur des évidences cliniques de l'utilisation de nouvelles armes n'ont pas ainsi suscité l'attention technique et - par conséquent - une stratégie pour la protection de la population contre le danger causé par ces armes n'a pas été recommandée. En tout cas, les déclarations verbales de FDI ont été acceptées et intégrées dans le rapport en tant que conclusion finale. Des documents et des informations existent concernant les nouvelles armes utilisées dans Gaza et au Liban, ils ont été  rassemblées par les médecins, les victimes ou les personnes qui étaient présents sur les lieux des attaques. Le manque de recherche au sujet de la dénonciation de l'utilisation prolongée des armements nouveaux qui sont, d'un côté, des armements « non classifié », et qui, de l'autre côté, sont utilisés contre la population civile, pourrait s'élever à un manque sérieux d'action par les gouvernements et par la mission des institutions internationales de l'ONU et souligne ainsi le problème de la pertinence des institutions internationales en ce qui concerne la réglementation de l'utilisation de la force dans le monde et de leur potentiel qui devrait être censé de faire respecter les droits de l'homme et le règlement actuel de conduite de guerre.  

 

Le rapport environnemental d'UNEP est la seule mission d'exploration « matérielle »centrée sur les faits du Liban. Toutes les données de cet étude ont été analysées dans un laboratoire, le laboratoire de Spitz en Suisse, cela représente une différence par rapport aux études précédents d'UNEP qui a utilisé plus d'un laboratoire. Les aspects méthodologiques des études menés par l'équipe d'UNEP ont été également critiqués par les scientifiques indépendants qui ont produit des rapports sur la contamination en uranium dans plusieurs endroits au Liban (9).  

En attendant, il n'a pas été pris en compte et il n'a pas été mentionné comme souci dans la relation finale le fait qu'il y a de différents agents de contamination dans l'environnement qui peuvent être identifiés par les effets sur les animaux dans les secteurs bombardés; les méthodologies d'analyse pour les effets de toxicité attaquant les gènes sont disponibles et devraient être utilisées pour observer les changements environnementaux liés à la guerre. Maintenant, on est très concerné par la protection de la population et pour son droit à la santé et aux soins. Cela serait une négligence de ne pas agir dans cette direction.  

 

Conclusions et demandes

 

A notre connaissance, l'utilisation à Gaza et Tire, au Liban, des FLM (Focused Lethality Munitions) employant la technologie DIME (3) est indiquée par les médecins, les témoins et les données cliniques.

 

D'ailleurs, on a rassemblée des documents concernant les armes « intelligentes » qui ont été employée sélectivement sur des enfants à Gaza et Tire. Il n'a pas d'importance si ceci s'est produit pour un échec intrinsèque du contrôle « intelligente » quand les bombes ont été lâchées (échecs dans l'expérimentation) ou si elle était un essai délibéré des bombes, ayant une intensité différente, contre des innocents. Ces points ne prennent pas en considération la conscience, la loi et les victimes.

 

Nous comprenons les évidences concernant deux attaques différentes près de Sidon et Tire pendant les quels des civils sont morts, tout cela causé par le bombardement dans des espaces ouverts avec de bombes combustible-air de puissance élevée.  

 

Nous invitons le Conseil à favoriser et organiser la suite du travail de la Commission lors de sa prochaine réunion en juin 2024, en particulier deux groupes de travail doivent être établis :  

Un groupe international de médecins et de scientifiques médicaux indépendants du gouvernement et des militaires, libanais et palestiniens chargés de reconsidérer, grâce à leur expertise, les affirmations concernant l'usage des armes illégales, grâce aux évidences scientifiques et médicales déjà acquises et additionnelles.

 

Un groupe de médecins, de vétérinaires et de scientifiques médicaux internationaux, libanais et palestiniens chargés d'effectuer un essai pratique selon les procédures identifiées pour l'évaluation du risque sanitaire de toxicité des gènes et autre sur les animaux dans les secteurs bombardés et détruits dans les sud du Liban. Ces études contribueront à comprendre si la publication des alertes pour protéger la santé des enfants et de la population est nécessaire. Mais ils contribueront également à identifier les régions en danger et activer un procédé d'alerte dans les structures médicales locales qui ne peuvent pas actuellement faire face aux problèmes de santé qui vont peut-être se développer, concevoir des protocoles épidémiologiques pour les années à suivre ou créer une culture locale pour ce genre de suivi.  

 

Nous soutenons également les recommandations déjà publiées par la Commission pour le Conseil, tel que la demande (d°) « le Conseil devrait réclamer la mobilisation de l'expertise professionnelle et technique nécessaire pour faire face au désastre écologique concernant l'environnement maritime sur la côte libanaise. Dans ce contexte, il devrait être utile l'utilisation du système de convention de Barcelone concernant le centre régional d'action contre la pollution marine de la Méditerranéenne basé à Malte; et (e°) le Conseil devrait établir un procédé de suivi concernant les mesures à prendre, notamment pour la reconstruction du Liban et surtout les réparations pour les victimes parmi la population civile libanaise.

الأهداف:

 

 

ملاحظات تمهيديه

 أنشئت لجنة الأمم المتحدة للتحقيق في انتهاكات حقوق الإنسان في لبنان في 11 آب / أغسطس بأنها "هيئة مستقلة منتدبة من اجل إثبات الوقائع ، وليست بمحكمة ولا هيئة قضائية تهدف إلى تقييم الجريمة".

 لاحظت لجنة الأمم المتحدة لحقوق الإنسان في تقريرها عن لبنان (1) أن "سياسة (الجيش الإسرائيلي) ضم أي شخص مع الأعداء المحتملين قد تسبب انتهاكات لحقوق الإنسان ، وذلك بمثابة عقاب جماعي". إن جيش الدفاع الإسرائيلي مارس "الاستخدام العشوائي للقوة ضد المدنيين اللبنانيين" ، وأن "حقوق الإنسان لم تحترم". علاوة على "استخدام بعض الأسلحة غير المشروعة ، مثل استخدام الذخائر العنقودية... والمفرط الذي لا تبرره الضرورة العسكرية ، ويتجاوز حجج التناسب. كما أنها انتهاك صارخ "للاتفاقيات الدولية"

و من ثم أصدرت اللجنة ، في تقريرها الختامي في تشرين الثاني / نوفمبر 2024 ، قرارا شديدا إزاء خرق للاتفاقيات الدولية من قبل الجيش الإسرائيلي ، ولاستخدامه غير المشروع لبعض الذخائر وتنفيذ العقاب الجماعي على المدنيين. ومع ذلك ، كما ذكرت (النقطة 24) على انه "ليس من المعروف أن الأسلحة التي استخدمتها قوات الدفاع الإسرائيلية غير قانونية في حد ذاتها بموجب القانون الإنساني الدولي". بل ان "الطريقة التي استخدمت تلك الأسلحة في بعض الحالات تنتهك القانون. وتناولت اللجنة على وجه التحديد استخدام الذخائر العنقودية "واقتراح بدء إجراءات لحظر ما له تأثير الألغام ("... تعزيز إجراءات عاجلة لشمل الذخائر العنقودية ضمن قائمة الأسلحة المحظورة بموجب القانون الدولي ").

 رغم أن الإجراء المقترح لحظر الذخائر العنقودية يشكل خطوة ايجابية ويعزز الآمال بأن شيئا ما يمكن القيام به لإنفاذ التشريع الدولي الراهن على "قواعد الحرب" ، وان ندائات البرلمان الأوروبي  لتعليق النشاط في عامي 2024 و 2024 سوف تتحول فورا لقوانين. ومع ذلك فإن فقر القرارات النهائية بشان الوقائع التي انبثقت عن الأسلحة "الأخرى"المستخدمة ، مصحوبة ببيان في الوقت ذاته يبدو قاطع بان "الأسلحة المستخدمة من قبل الجيش الإسرائيلي في حد ذاتها قانونيه" موضحا سوء الفهم المقلق ، أو نقص إمكانية و انتشار الاستخدام"التجريبي"  ل"الأسلحة والذخائر المطورة أو معدلة حديثا". التقرير يقصر في الإجابة عن القلق البالغ الذي أدى إلى صعود  التفويض من اللجنة.

 علاوة على ذلك لم يكرس أي انتباه للالتزام  أو إغفال لاحترام لقواعد القانون الإنساني الذي تقتضي الى تقييم الاسلحة قبل استخدامها للحرب بالنسبة ل"شرعيتها" في ضوء المعايير القائمة. محكمة العدل الدولية كررت هذا في قضيتها "النووية"

 حفز اللجنة كلا من حرب لبنان 2024  و حملة الصيف بعزة  التي كانا يمتازان – إذا لم يكنا فريدتان في هذا القرن و بالتأكيد بأساليب شمولية – بحداثة و نوعية الخسائر  التي ابلغ عنها المدنيين. مما أشار لاحتياجيه التفقد بعمق من اجل توثيق حداثة الوكلاء المصنعين لهذه الأسلحة/الذخائر المستخدمة.

 في تقرير اللجنة ،تم ذكر ادعائات من شهود مختلفين و متعددين (النقطة 247) : " ادعائات بشأن استخدام الجيش الإسرائيلي لمجموعة من الأسلحة ، أو بعبارة أدق ، الذخيرة التي يمكن اعتبارها غير قانونيه. وهناك مزاعم حول استخدام اليورانيوم المنضب والفسفور الأبيض ومتفجرات الوقود والهواء. بعض الشهود أيضا لفتوا أنظار اللجنة لإصابات وصفوها بأنها غير طبيعية ، مثل تفحم الجسم مع احتفاظه بالجثة، أو أجساد أفراد قد تبخرت بكل بساطة". في معالجة هذه القضايا في أجزاء محددة من التقرير ، من الواضح أن تم إعطاء بيانات مختلفة الأهمية و الوزن للجنة من جيش الدفاع الإسرائيلي بالمقارنة مع التقارير الواردة من الأطباء ، العلماء والناس في لبنان ، وحتى بين أفراد الينيفل UNIFIL. وهكذا تختتم اللجنة ، في مواجهة الخلاف بين الشهود ، وتجاهلا الوقائع المسجلة والادله المادية ، أن (النقطة 24 ) "من المعروف أن الأسلحة التي استخدمها الجيش الإسرائيلي في حد ذاتها قانونيه بموجب القانون الإنساني الدولي".

 أسباب التشكيك في نتائج التحقيق والمطالبة بإعادة فتحه

 هناك سببين لتشكيكنا في ما ورد من نتائج أعلاه:

 

نحن أنفسنا ،ليس كمحامين بل كأطباء و علماء ، نجد العزيمة لإثارة هذه القضايا أمام المجلس لان من بين كل الاهتمامات الأخرى من حيث احترام القوانين الدولية والاتفاقيات والتوصيات ، تؤدي هذه الأخطاء كنتيجة لعدم الاكتراث برصد المخاطر المترتبة عن تعرض السكان لمختلف وسائل التلوث / المسممة على صحة السكان في المستقبل.ءءء. ومع ذلك ، من وجهة نظر الأطباء والعلماء و طبقا لحقوق الإنسان للسكان ،هذه قضايا أساسية.

بتفاصيل تقرير الأسلحة المستخدمة التي تعرفها الجنة نفسها بأنها ذخائر غير قانونية، بغض المقتطفات توضح أسباب شكنا بشكل أفضل؛

 

1-    الفسفور الأبيض
(النقطة 259)
، ذكر ذلك "في مارواحين في 16 تموز أثناء جمع من المدنيين في القرية قبل إجلائهم تحت إشراف قوة الينيفل UNIFIL. هذا وقد شهد المدنيين المعنيين وقابلتهم اللجنة. كما يؤكد ذلك ضباط قوة الأمم المتحدة في الموقع …. 12 طلقة للفوسفور الأبيض قد أطلقت مباشرة على المدنيين ". علاوة على ذلك (النقطة 261) "في 23 تشرين الأول أفيد في صحيفة الغارديان أن الحكومة الإسرائيلية" اعترفت بأنها استخدمت أسلحه… الفوسفور في هجماتها ضد أهداف خلال أشهر الحرب الطويلة في لبنان هذا الصيف ". الاعتراف الإسرائيلي أدلى به الوزير يديري جاكوب ، الذي سئل عن هذا الموضوع من قبل زاهافا غال - اون ، عضو الكنيست. السيد يديري قال أن " جيش الدفاع الإسرائيلي الذخيرة يمتلك ذخائر الفوسفور في أشكال مختلفة. استخدم الجيش الإسرائيلي قذائف فوسفوريه أثناء الحرب ضد حزب الله في هجمات ضد أهداف عسكرية في ارض مفتوحة".

كان المرء يعتقد أن الإبلاغ الجماعي من قبل المدنيين وقوة الينيفل
 UNIFIL ، وإساءة استخدام من قبل صحيفة دولية ( كذلك صحيفة هارتس) ورقة عمل الذخائر ، كانت على الأقل قد تحددت التصديق المعطى بشكل خاص للبيان المقدم من حزب يتسم بتضارب المصالح الواضح كالوزير يديري. كان من الخطأ أن تنفي اللجنة وجود أي خرق للقواعد بعد أن صوبت ورقة العمل كسلاح ضد السكان. فهذا يجب توضيحه عن طريق المزيد من التحقيق والمداولات.
 

2-     ومتفجرات الوقود والهواء
في نهاية المطاف اعترف الجيش الإسرائيلي استخدامه لهذه الأسلحة الا بأنه "غطاء ضد الألغام". وعلى الرغم من الادله و التصريحات السابقة لأطباء لبنانيين حول الملامح الطبية لإصابات الضحايا من المدنيين والتي كانت تتصف بالتعرض للانفجار كتل نار من أسلحة وقود الهواء ، مرة أخرى قبلت اللجنة بيان جيش الدفاع الإسرائيلي الذي ورد أعلاه.

الجيش الإسرائيلي لم يستوعب البيانات الأخرى و / أو التي تحتاج إلى مزيد من التحقيق فى القضايا. و فيما يخص استخدام الذخيرة / القنابل / القذائف الوقودية- الهوائية ، وكان هناك معلومات واسعة النطاق في لبنان و بالخارج نظرا لكون الشك في استخدامها المذكور من قبل الأطباء في يوليو 2024 لمجلس الأطباء اللبنانيين والى الحكومة اللبنانية. أظهرت تقارير الأطباء في الصحافة و بالتلفزيون في لبنان ، في العالم العربي وفي أوروبا، سمات غير عادية من جثث الضحايا المدنيين الذين تعرضوا للهجوم أثناء السفر في العراء من القنابل والصواريخ التي ألقتها الطائرات. نحن نتساءل كيف نجت هذه الادله من مواصلة التحقيق.
 نقترح مرة أخرى ، بناء على موعد توحيد هذه التقارير أن المجلس ينصح بالعمل على مزيد من التحليل ل"حادث" تم التبليغ عنه في جسر رامهالليي قرب صيدا ، وأخر مماثل  قريبة نكل. أقوال الشهود و الوثائق التقنية و والطبية لكلا من السيناريوهين متوافرة عند الطلب من المجلس ، وإذا كان للتحقيق أن يفتح،  كما نطلب هنا

 القنابل الصغيرة و المتفجرات المحشوة بالمعادن ' DIME' والأسلحة الذكية هم أدوات من اجل "الحد من الأضرار الجانبية" التي يصفها لواء السلاح الجوي الإسرائيلي اللواء اسحق بن إسرائيل بأنها صممت "لتمكين كل مت هو مستهدف لضربه بدون الأضرار بالمارة أو الأشخاص الآخرين". "قنبلة صغيرة القطر ، عدلت لإدراج مركب حالة كثيفة ومعادن خاملة متفجرة (DIME) ، توفر أمكانيه إيصال بدقة قاتلة الانفجار ضد الأهداف السهلة وانخفاض مذهل للإضرار الجانبية" (4). رغم انه قيل أن في صيف 2024 "النسخة الأميركية لا تزال في مرحلة الاختبار ولم تستخدم في ساحة المعركة في ذلك الوقت (5) أعلن أن الاختبار (الافتراضي) تم تمويله من داربا  DARPA  (6) في كانون الثاني / يناير 2024. يمكن للجنة الاطلاع أو لمعرفة إذا ما أنجز في السنة التالية ونصف أي قبل هجمات الجيش الإسرائيلي ، أو إذا نشرت إسرائيل "النسخة الإسرائيلية" لهذا النوع من الأسلحة.

 حظيت الالتماسات، التي طالبت بضرورة تقصي الحقائق حول هذه المسألة، باهتمام الناس من خلال عدد من الأطباء الذين شهدوا الحرب في أقسام الطوارئ والجراحة في لبنان وغزة. فهم كانوا مدركين لكثرة الإصابات الغامضة التي لا يمكن كشفها بدون وجود الشظايا التي يمكن رؤيتها أو الكشف عنها بالأشعة في الأجساد، والتي كان لها مضاعفات طبية لم يُشهد لها مثيل من قبل. أشار تقرير صحفي، معزز بتحاليل علمية، أن أسلحة من نوع المتفجرات المحشوة بالمعادن (DIME) هي تتسبب في مثل هذه الجروح وحالات الوفاة التي ذكرها الأطباء في تقاريرهم في غزة (7).

  وقد أصبح من الممكن الآن تقييد أن الأطفال وكبار السن في منطقة صور في لبنان الذين كانوا ينقذون ذويهم القتلى قد تعرضوا "لأسلحة موجهة" والتي تسببت لهم بجروح مشابهة.  وبما أن المفوضية، فيما يتعلق بهذه المسألة تحديداً، قد فضلت من جانب واحد إعلان طرف لديه تعارض في المصالح، فإننا نطالب المفوضية بإعادة فتح التحقيق وتشكيل لجنة مستقلة وجديدة للنظر في الدليل الشفهي والوثائق التي تدعمه حول استخدام هذه الأسلحة.  وإفادات الشهود والوثائق الطبية/التقنية التي تثبت هذه الحالات متوفرة عند الطلب من المجلس إن قام بالمصادقة على إعادة فتح التحقيق، كما نطالب هنا.

والقاسم المشترك الذي يجمع بين جميع هذه الأسلحة المذكورة أعلاه أنها لا تخطيء أي هدف يمكن رؤيته "بالعين المجردة"، وأنه من الصعب تحديدها في حالات الطوارئ. ومما يزيد الأمر صعوبة أيضاً هو العناية بالمصابين في الظروف التي تشهد بعض الهدوء.  وحقيقة أنها لا تترك شبراً في جسد الضحية دون أن تصيبه، فإن هذا يعني أن هذه الأسلحة لا تراعي المادة رقم 8 من مواثيق الحرب. ويتطلب أمر توضيح طبيعة استخدام هذه الأسلحة، بالنتيجة، جمع مختلف أنواع المعلومات والحقائق وأن يتم تدعيم لجنة تقصي الحقائق بمنهج تقصٍ علمي وطبي.

 ومن القواسم الأخرى التي تجمع بين هذه الأسلحة هو عدم وجود تشريع معين يسمح باستخدامها. ويعني هذا أيضاً أنه لم يتم تحديداً حظر استخدام أي من هذه الأسلحة. يعود غياب تشريع محدد بخصوصها إما إلى حداثتها (المتفجرات المحشوة بالمعادن (DIME)، قنابل صغيرة) أو إلى التعديلات التي أجريت عليها (الأسلحة الجوية التي تعمل بالوقود)، أو إلى حقيقة أنه تم استخدامها بطرق مختلفة عن الاستخدام المسموح به (WP).  فجميع هذه الأسلحة تمتاز بأن وصفها " ضائع بين هذا وذالك" وأنها رمادية التوصيف وحالة قانونية "غير مبتوت فيها".  

 لكن، في الوقت ذاته، عدم شرعيتها أمر معترف به ، وذلك استناداً إلى المواثيق السائدة حالياً والتي تُجمع جميعا بشكل عام على حظر جميع الأسلحة التي لا يمكن اقتفاء أثرها في أجساد الضحايا، إلا باستخدام التحاليل المعقدة، و/أو استناداً إلى حقيقة أن مداها الأقصى لا يقتصر على هدف معين، أو بسبب الطبيعة الكيميائية لعواملها النشطة.

 وفي ضوء ضبابية الحدود التشريعية لشرعية أو عدم شرعية الأسلحة موضوع النقاش، فإن اعتراف جيش الدفاع الإسرائيلي باستخدام الأسلحة الجوية التي تعمل بالوقود من أجل تفجير الألغام فقط، واستخدام مادة الفسفور الأبيض فقط ضد/فوق المنشآت العسكرية، واستخدام القنابل/الصواريخ الصغيرة "الذكية" فقط بهدف الحد من عدد الإصابات؛ يثير هذا الاعتراف الشكوك حول عدم وجود مبرر معقول حول وجودها في أرض المعركة وينم عن أنها طريقة لجعل ما ينتج عن استخدامها "من أخطاء أو توسيع طريق استخدامها" أمراً مقبولاً مما يمهد الطريق لتبرير تكرار استخدامها.

ونحن حقيقة لا نرغب أن نرى عملية تقصي حقائق كان الهدف منها إيجاد الحقيقة لينقلب الأمر وتصبح طريقة تسمح بتسمية وتبرير وجود واستخدام مجموعة من الأسلحة غير الشرعية في الحرب، مما يضعف من القوانين الصارمة التي نصت عليها مواثيق جنيف وتلك التي نص عليها ميثاق الحد من الأسلحة الكيميائية وأسلحة الدمار الشامل الأخرى.

ومن الجدير ذكره أيضاً أنه تم شجب استخدام جيش الدفاع الإسرائيلي لمثل بعض هذه الأسلحة المذكورة آنفاً في غزة كذلك، والتقارير والشهود التي تؤكد هذا الاستخدام متوفرة. لم يكن بحوزة المفوضية أي معلومات من غزة منذ عهد جون دوجارد John Dugard ، المقرر الخاص حول أوضاع حقوق الإنسان في المناطق الفلسطينية المحتلة، والذي كلفته المفوضية بتولي مهمة تقصي حقائق عاجلة.  وقد أحبطت السلطات الإسرائيلية محاولته بتنفيذ "مهمة تقصي للحقائق عالية المستوى" ومنعته من السفر إلى بيت حانون في قطاع غزة لإجراء مسح ميداني في غزة. ولا تحتاج هذه الحقيقة إلى أي تعليق، ولم نعرف بعد إذا ما تمكن من الوصول إلى هناك لإجراء المسح أم لا.

 الحديث عن التوصيات النهائية للمفوضية

توصي المفوضية في تقريرها النهائي بفتح تحقيق آخر (2)، وتصرح "بضرورة المضي قدماً في البحث العلمي الذي يجري العمل عليه حالياً في لبنان وفي الخارج حول آثار أسلحة معينة تم استخدامها أثناء النزاع"، وتقترح "بأن تكون النتائج حاسمة فيما يتعلق بالتحقق من شرعية "أسلحة جديدة" معينة في ضوء القانون الإنساني الدولي. يجب على المجلس أن يُشجع هذه الجهود وأن يتابع التطورات".

 والطلبات التي نتقدم بها من المجلس هي في عموميتها متوافقة مع هذه التوصيات، لكننا نضيف بعض النقاط والتحذيرات، كما هو مدرج أدناه.

 الشفافية- لم يأتي التقرير على ذكر من هي الجهات المسئولة على البحث الإضافي، أي إذا ما كانت مستقلة عن الحكومات والأحزاب السياسية أم لا.

 المنهجية- يجب التأكيد على نوع أدوات التحقيق التي سيتم استخدامها على الأرض وما هي المنهجية المبرمجة من أجل الحصول على المعلومات.

  ولكليهما علاقة مباشرة مع استقلالية الفريق العلمي. نثمن ونقترح على المجلس بشدة بضرورة الأخذ بهذه النقاط المحددة وتداولها من أجل الخروج ببحث مؤهل وليس فقط بحثاً معمماً.

 تشريع المسؤولية المؤسساتية- قام الكثير من الأطباء في كل من غزة ولبنان بالتنديد باستخدام إسرائيل طيلة فترة هجماتها في عام 2024 لأسلحة جديدة في كلا الموقعين من خلال إرسال رسائل رسمية إلى المؤسسات المحلية والإفادات العلنية التي تقدموا بها في وسائل الإعلام. وكان هؤلاء هم الأطباء الذين استقبلوا الضحايا، الجرحى منهم والقتلى. فقد قام أطباء لبنانيون بتوجيه رسائل رسمية إلى حكومتهم وإلى نقابة الجراحين اللبنانيين. وأجريت اللقاءات الصحفية مع كل من أطباء لبنان وغزة التي حظيت بانتشار واسع لكنها لم تؤخذ بعين الاعتبار. ودعا العلماء الدوليون إلى إجراء تحقيقات مستقلة بناءً على هذه التقارير، وإلى إجراء تحقيق علمي مستقل تقوده الأمم المتحدة حول هذه الحالات. وبصفتنا مجموعة علمية دولية مستقلة، حاولنا الحصول على معلومات مباشرة من الحكومة اللبنانية ومن الشخص المسئول في منظمة الصحة العالمية في لبنان ومن المحقق الدولي حول إذا ما تم تشكيل بعثة علمية/طبية أو إذا ما بدأت مثل هذه البعثة عملها فعلاً أم لا.  لكن جميع هذه الطلبات والتوجهات لم تحظى بأي رد.

 وقد يكون بعض الأطباء الذين تحدثنا عنهم أعلاه قد أفادوا بما لديهم للبعثة، لكن ليس هناك من أسباب واضحة لعدم إعطاء تقارير المختص، إن تم السعي للحصول عليها، الاهتمام اللازم، وكذلك لعدم إجراء تحليل مشترك للتقارير من قبل فريق من الأطباء والعلماء، أو على الأقل لم يُذكر هذا في التقرير النهائي. ولم تحظى التنديدات التي استندت على أدلة طبية على استخدام أسلحة جديدة الاهتمام التقني، وبالتالي لم يتم التوصية ببلورة إستراتيجية للحماية من التلوث الذي قد ينتج عن الخطر المحتمل المترتب على استخدام هذه الأسلحة.

 على العكس من ذلك، تم الأخذ بتصريحات جيش الدفاع الإسرائيلي على أنها حقيقة لا تقبل النقاش وتم إقرارها في التقرير على أنها استنتاجات نهائية.

 لم يتم جمع أي توثيقات أو معلومات جديدة   من خلال الأطباء أو الضحايا والأشخاص الذي تواجدوا في موقع الهجمات حول استخدام أسلحة جديدة في غزة ولبنان.

غياب أجراء تحقيق إضافي حول التنديد بالاستخدام الموسع للأسلحة الجديدة، التي لم يتم "البت فيها" بعد من جهة، والتي تم توجيهها ضد سكان مدنيين من جهة أخرى، عمق القصور الخطير في مساعي الحكومات وبعثات مؤسسات الأمم المتحدة الدولية ومواقفها حول المسألة الأساسية المتعلقة بدور المؤسسات الدولية في تنظيم وتوجيه استخدام القوة في العالم وفي قدرتها على فرض احترام حقوق الإنسان السائدة حالياً بأساليب سلمية وفرض لائحة حسن التصرف في الحرب.

 ويعتبر التقرير البيئي الصادر عن برنامج الأمم المتحدة للبيئة (UNEP) هو بعثة تقصي الحقائق "المادية" الوحيدة، حسب علمنا، التي تم القيام بها في لبنان. وقد تم تحليل البيانات التي احتوى عليها هذا المسح في أحد المختبرات، وهو مختبر سبيتز Spits في سويسرا.  علماً أنه تم تحليل مسوح سابقة قام بها برنامج الأمم المتحدة للبيئة في أكثر من مختبر.  وقد تعرضت الجوانب المنهجية لآلية تقصي الحقائق من قبل فريق برنامج الأمم المتحدة للبيئة للنقد من قبل علماء مستقلين الذين أعدوا تقارير حول وجود تلوث يورانيوم في بعض المواقع في لبنان (9). 

 في هذه الأثناء، لم يُعنى، ولم يعتبرها التقرير النهائي أنها مدعاة للقلق، بحقيقة أن التأثيرات المصاحبة لمختلف أنواع التلوث الموجود في البيئة يمكن تتبعها منذ الآن والتي تظهر آثارها في الحيوانات التي تعيش في المناطق التي تعرضت للقصف، وأن طرائق تحليل الآثار السامة للجينات متوفرة ويجب استخدامها لمعرفة إذا ما كان هناك أي تغير بيئي ناتج عن الحرب. في هذا الوقت، هذه هي أكثر الأمور الملحة المرتبطة بحماية السكان وحقهم في الرعاية الصحية، وسيكون من الإهمال عدم اتخاذ أي إجراء في هذا الاتجاه.

 الاستنتاجات والمطالب

 حسب علمنا، أشار الأطباء والشهود وكذلك البيانات الطبية إلى استخدام تكنولوجيا الذخائر الفتاكة المركزة (FLM) من خلال استخدام المتفجرات المحشوة بالمعادن (DIME) في كل من غزة، ومنطقة صور في لبنان.

علاوة على ذلك، هناك دليل واضح على أنه قد تم استخدام الأسلحة "الذكية" بشكل انتقائي ضد الأطفال في كل من غزة و صور.  من غير المعقول أن يكون هذا قد حدث نتيجة إخفاق داخلي في نظام التحكم "الذكي" لإطلاق القنبلة في الميدان (الإخفاقات في التجريب)، أو أنه كان اختبار مقصود للقنابل ذات الكثافة المختلفة على أناس عزل.  هذه النقاط لا يقبلها عقل أو قانون، وكذلك لا يقتنع بها الضحايا.  كما أننا مقتنعون بهذا الدليل استناداً إلى هجومين مختلفين قرب صيدا وصور حيث سقط مدنيين نتيجة قصف في مساحات مفتوحة باستخدام معدات جوية تعمل بالوقود وتتمتع بقوة عالية.

 نطالب المجلس بأن يقوم، في اجتماعه القادم في حزيران 2024، بتشجيع وتنظيم استمرارية عمل المفوضية بشكل فوري، وخاصة تشكيل مجموعتي عمل:

 

l        لجنة مستقلة (عن الحكومة والجيش) ودولية من الأطباء والعلماء اللبنانيين والفلسطينيين تكون مهمتها إعادة النظر، في نطاق تخصصهم، في الشكاوى حول استخدام الأسلحة غير المشروعة، من خلال جمع الأدلة العلمية والطبية الإضافية، وكذلك النظر في الأدلة المتوفرة.

 

l        لجنة من الأطباء والبيطريين والعلماء الدوليين واللبنانيين والفلسطينيين وتكون مهمتهم القيام بالاختبارات استناداً إلى الإجراءات المتعارف عليها لتحديد الآثار السامة للجينات والمخاطر الصحية الأخرى على الحيوانات التي تعرض للقصف الشديد والدمار المكثف في جنوب لبنان.  من شأن هذه الدراسات أن تكون ذات نفع إن أ)  ضمنت إصدار نشرات تحذير من أجل صحة الأطفال والسكان. ب)   حجر المناطق المتعرضة للخطر. ج)  تفعيل نظام إنذار في المنشآت الصحية المحلية التي لا تستطيع حالياً التأقلم مع أي ظهور محتمل لأي مشاكل صحية. د)  تصميم بروتوكولات خاصة بعلم الأوبئة للسنوات المستقبلية القادمة، و

 هـ)  خلق ثقافة محلية لمثل هذا النوع من المتابعة.

 كما أننا نؤيد التوصيات التي صدرت عن المفوضية إلى المجلس، مثل الطلب بأن () "يدعوا المجلس إلى حشد الخبرة المهنية والتقنية اللازمة من أجل التعاطي مع كوارث الأوبئة في البيئة البحرية في الشاطئ اللبناني وما وراء ذلك. في هذا السياق، سيكون من المفيد استخدام نظام ميثاق برشلونة ليشمل مركز الاستجابة لحالات التلوث الطارئة في منطقة حوض البحر الأبيض المتوسط والبحار الإقليمية لمنطقة البحر المتوسط ومقره مالطا؛ و() وأن يقوم المجلس بوضع إجراء متابعة للإجراءات التي سيتم اتخاذها، خاصة من أجل إعادة بناء لبنان وفي المقام الأول تعويض الضحايا من السكان المدنيين اللبنانيين".

(3) ينتج الدايم DIME داخل دائرة مشروع معمل أبحاث القوات الجويةAFRL  ممولة من الحكومة الفيدرالية للولايات المتحدة. و يديره AFRL و AAC (دامجة التكنولوجيا ضمن مفهوم التكنولوجيا المتقدمة (ACTD)  الواقعة في فلوريدا بيغلين AFB   و المتعاقد SDB I ، أي شركة بوينج في سانت لويس.
