The United States-led occupation continues to demolish humanitarian law with impunity in Iraq

 

Occupying powers have bred a culture of insecurity that destroys the lives of ordinary Iraqis

 

International institutions, monitoring bodies and parliaments must act or risk irrelevance


  

Three years have passed since the United States launched an illegal war of aggression on the sovereign Republic of Iraq. Neither were weapons of mass destruction found nor democracy or human rights advanced. Within one month, Iraqis will enter their fourth year as a people under occupation, ruled by a puppet regime that sanctions death squads and torture.

 

The time has long passed for this to end.

 

In the words of John Pace — until recently head of the UN Assistance Mission in Iraq — “the ordinary Iraqi has absolutely no protection whatsoever from the state or from the authorities.” Pace adds that, “the prevalence torture is quite clearly established,” that “the degree of violence has increased exponentially since the invasion,” and that “the country has been blown apart in terms of its social structures and social fiber.”

 

In the absence of a sovereign Iraqi government — which cannot exist, by definition, under occupation — the US-led Multi-National Forces in Iraq (MNF-I) are legally responsible, and imputable, for the failure to protect even the most basic of all human rights principles: the right to life. The current situation is intolerable. Workers in the morgue of Baghdad alone report that on average 1600 corpses are brought in every month. Following the criminal destruction of Al-Askari mosque in Samarra, these same workers report that 1300 dead were brought in over a period of seven days.

 

The US-led occupation has consciously led Iraq to the verge of disintegration. The country is being plundered. Torture and assassinations are endemic. Women and children have borne an equal share of the violence. The occupation is running out of space for prisoners. Cities have been targeted and destroyed in a programme of urbicide — Fallujah, Tel Afar, Al-Qaim, Haditha. US coordinated air strikes and related military interventions are the biggest killer in Iraq. Repeated polls in Iraq have shown that Iraqis believe they would be safer if foreign troops left.

 

A culture of intended destruction

 

As the year 2006 opens, we have no other conclusion to draw except that the United States has intended destruction upon the people of Iraq. The use of depleted uranium weaponry will leave a scar on Iraq for billions of years. All public services have collapsed — health, water, electricity, communications, justice and security. The occupation has done nothing to protect Iraqis. Refusing to safeguard civilians is as much a violation of international law as the criminal use of chemical agents — such as white phosphorus on Fallujah and Tel Afar. Criminal inaction, especially following the Samarra atrocity — the US military standing by as death squads roam the streets of Iraq — has highlighted with precision the underlying rationality of the US presence in Iraq: impoverish the country, break it up, foment sectarian hatred, stand back and watch the killing fields swallow the population.

 

Silence is complicity

 

The international community has failed Iraq, and the Iraqi people. A decade of silence over murderous sanctions has been compounded with timidity as the United States overturned a century of legal regulation and waged an illegal preemptive war on a state that was already on its knees.

 

The BRussells Tribunal, in solidarity with the Iraqi people and its struggle to recover sovereignty, calls on all international organizations and institutions that work towards upholding international law, as well as national parliaments and regional organizations, to act now and with purpose.

 

International institutions, monitoring bodies and parliaments must recognize the gravity of the situation and act to protect the life and person of all Iraq civilians, condemn US policies in Iraq, demand the unconditional and immediate withdrawal of all foreign forces, demand the US and all other occupying powers pay reparations to Iraq and compensation to Iraqis for the human and material destruction wrought, restore in full Iraqi sovereignty, recognize as null and void any treaty, law or contract passed under occupation, and bring again a semblance of credibility to the legal underpinnings of international society.

 

When the powerful claim a state of exception to law the rights and obligations of all are undermined. The situation in Iraq is disgrace to us all. It is time for all actors in positions of authority and influence to rediscover their conscience, as well as their mandate and legal obligations, and speak up and ensure the end of this atrocity now.

Illegalità USA: Dov’è il limite?

 

L’occupazione guidata dagli Stati Uniti continua a demolire con impunità la legge umanitaria in Iraq

 

I poteri di occupazione hanno generato una cultura di insicurezza che distrugge le vite degli irakeni

 

Le istituzioni internazionali, i soggetti di controllo e i parlamenti devono agire o rischiare irrilevanza

 

Tre anni sono passati da quando gli Stati Uniti hanno lanciato una guerra di aggressione illegale contro la sovrana Repubblica dell’Irak. Né armi di distruzione di massa sono state trovate né democrazia e diritti umani sono avanzati. Tra un mese gli irakeni entreranno nel loro quarto anno come un popolo sotto occupazione, governato da un regime fantoccio che sanziona squadre della morte e tortura.

 

E’ gia passato da molto il tempo affinché tutto questo finisca.

 

Con le parola di John Pace – fino recentemente alla guida della Missione UN di Assistenza in Irak – “gli irakeni non hanno assolutamente nessuna protezione dallo Stato o dalle autorità”. Pace aggiunge che “la prevalente tortura è chiaramente stabilita”, che “il grado di violenza è aumentato esponenzialmente dall’invasione”, e che “il paese è stato distrutto in termini di strutture e fibra sociale”.

 

In assenza di un governo sovrano irakeno – che non può esistere per antonomasia sotto occupazione – le Forze Multinazionali in Irak guidate dagli Stati Uniti (MNF-I) sono legalmente responsabili, e imputabili, per aver fallito nel proteggere anche il piú semplice dei diritti umani: il diritto alla vita. La situazione corrente è intollerabile. Gli impiegati dell’obitorio della sola città di Bagdad riportano che una media di 1600 cadaveri sono portati all’obitorio ogni mese. Dopo la distruzione criminale della moschea di Al-Askari in Samarra, questi stessi impiegati riportano che 1300 cadaveri sono stati portati all’obitorio in un periodo di sette giorni.

 

L’occupazione guidata dagli Stati Uniti ha coscientemente portato l’Irak sull’orlo della disintegrazione. Il paese è saccheggiato e razziato. Tortura e assassinii sono endemici. Donne e bambini subiscono la stessa violenza. L’occupazione non sa piú dove rinchiudere i prigionieri. Intere città sono state bersagliate e distrutte in un programma di ‘urbicidio’ - Fallujah, Tel Afar, Al-Qaim, Haditha. Gli attacchi aerei coordinati e relativi interventi militari da parte degli Stati Uniti sono il maggior ‘killer’ in Irak. Ripetuti sondaggi in Irak hanno mostrato che gli irakeni credono che sarebbero piú al sicuro se le truppe di occupazione straniere se ne andassero.

 

Una cultura di distruzione cosciente

 

In questo inizio del 2006 non abbiamo altra conclusione da trarre se non quella che gli Stati Uniti hanno voluto la distruzione del popolo irakeno. L’uso di armi con uranio impoverito lascerà una ferita in Irak per miliardi di anni. Tutti i servizi pubblici sono distrutti – salute, acqua, elettricità, comunicazioni, giustizia e sicurezza. L’occupazione non ha fatto alcunché per proteggere gli irakeni. Rifiutare di proteggere i civili è una grave violazione della legge internazionale cosí come l’uso criminale di armi chimiche – come il fosforo bianco su Fallujah e Tel Afar. L’inazione criminale, specialmente dopo le atrocità di Samarra – le forze militari americane sono restate a guardare mentre squadre della morte razziavano per le strade dell’Iraq – ha evidenziato con precisione la razionalità nascosta della presenza americana in Irak: impoverire il paese, distruggerlo, fomentare l’odio settario, tirarsi indietro e restare a guardare il teatro delle uccisioni ingoiare la popolazione.

 

Il silenzio è complicità

 

La comunità internazionale ha fallito e tradito l’Irak e gli irakeni. Un decennio di silenzio sulle sanzioni assassine è stato aggravato con la soggezione quando gli Stati Uniti hanno abbattuto e rovesciato un secolo di legalità e hanno mosso una guerra “preventiva” illegale contro uno stato che era già stato messo in ginocchio.

 

Il BRussells Tribunal, in solidarietà con il popolo irakeno e la sua lotta per riconquistare la sovranità, chiama tutte le organizzazioni internazionali e istituzioni che lavorano per il rispetto della legge internazionale, i parlamenti nazionali e le organizzazioni regionali, ad agire ora e con scopo.

 

Le isituzioni internazionali, i corpi di monitoraggio e controllo e i parlamenti devono riconoscere la gravità della situazione e agire per proteggere la vita di tutti i civili iracheni, condannare le politiche degli Stati Uniti in Irak, chiedere il ritiro immediato e senza condizioni di tutte le truppe straniere, esigere che gli Stati Uniti e gli altri poteri di occupazione paghino riparazioni all’Irak e compensi agli irakeni per la distruzione umana e materiale perpetrata, ristabilire in pieno la sovranità irakena, riconoscere come nulli e invalidi tutti i trattati, leggi e contratti passati e siglati sotto occupazione, e riportare una sembianza di credibilità alle basi legali della società internazionale.

 

Quando il potente pretende uno stato di eccezione alla legge, i diritti e le obbligazioni di tutti sono minacciati. La situazione in Irak è una disgrazia per noi tutti. E’ tempo per tutti gli attori in posizione di autorità e influenza di riscoprire la propria coscienza, cosí come il loro mandato e obbligazioni legali e levare la loro voce e garantire la fine di questa atrocità ora.

L’illégalité US en Irak : Où est la limite ?

 

L’occupation conduite par les États-Unis continue en toute impunité de démolir en Irak le droit humanitaire

 

Les puissances occupantes ont engendré  une culture d’insécurité qui détruit les vies le commun des irakiens

 

Institutions internationales, organes de surveillance de l'application des traités et parlements doivent agir sous peine d’inconsistance

 

Trois années ont passé depuis que les Etats-Unis ont lancé une guerre d’agression illégale contre la République souveraine d’Irak. La démocratie et les droits de l’homme ne sont pas plus là que les armes de destruction n’y étaient. D’ici un mois, les irakiens vont entrer dans leur quatrième année de peuple sous occupation, gouverné par un régime fantoche qui autorise les escadrons de la mort et la torture.  

Il y a longtemps qu’il faut que cela cesse.

Tel que le formule John Pace — récemment encore à la tête de la Mission d’Assistance de l’ONU en Irak — « le commun des irakiens ne bénéficie d’absolument aucune protection, que ce soit de l’État ou des autorités. » Pace ajoute que « la torture généralisée est très clairement établie », que « le degré de violence a  crû exponentiellement depuis l’invasion » et que « le pays a été éclaté dans ses structures et sa fibre sociales ».

En l’absence d’un gouvernement irakien souverain — qui, par définition, ne peut exister sous occupation — les forces multinationales conduits par les États-Unis en Irak (MNF-I) son légalement responsables, et justiciables, de l’échec à protéger même le principe le plus élémentaire des droits de l’homme : le droit de vivre. La situation actuelle est intolérable. Les travailleurs de la seule morgue de Bagdad rapportent que 1600 cadavres sont apportés chaque mois. À la suite de la destruction criminelle de la mosquée Al-Askari à Samarra, les mêmes travailleurs rapportent que 1300 morts furent apportés sur une période de sept jours.

L’occupation conduite par les Etats-Unis a consciencieusement conduit l’Irak au bord de la désintégration. Le pays est pillé. La torture et les assassinats sont endémiques. Femmes et enfants ont supporté une part égale de la violence. L’occupation en vient à manquer d’espace pour ses prisonniers. Les villes ont été prises pour cibles et détruites, dans un programme d’urbicide — Fallujah, Tel Afar, Al-Qaim, Haditha. Ce sont et les interventions militaires liées aux raids aériens coordonnés par les Etats-Unis et ces rais eux-mêmes qui tuent le plus Irak. Les scrutins répétés en Irak ont montré que les irakiens croient que si les troupes étrangères partaient, ils seraient plus protégés.


Une culture de destruction
préméditée

Alors que s’ouvre l’année 2006, nous n’avons pas d’autre conclusion à esquisser si ce n’est que les Etats-Unis ont prémédité une destruction du peuple irakien. L’usage d’uranium appauvri laissera pour des milliards d’années une cicatrice en l’Irak. Tous les services publics se sont effondrés — santé, eau, électricité, communications, justice et sécurité. L’occupation n’a rien fait pour protéger les irakiens. Le refus de protection aux civils n’est pas moins une violation du droit international que l’usage criminel d’agents chimiques — tel le phosphore blanc à Fallujah et Tel Afar. L’inaction criminelle, particulièrement suite à l’atrocité de Samarra — les militaires US se tenant coi alors que des escadrons de la mort écument les rues d’Irak — a mis en lumière avec précision la rationalité qui sous-tend la présence US en Irak : appauvrir le pays, le briser, fomenter la haine sectaire, s’écarter pour regarder les charniers engloutir la population.


Le silence est complicité

La communauté internationale a failli à l’Irak, et au peuple irakien. Une décennie de silence sur des sanctions meurtrières a été timidement compensée alors que les États-Unis renversaient un siècle de réglementation légale et lançaient une guerre « préemptive » illégale  contre un État qui était déjà sur les genoux.

Le BRussells Tribunal, en solidarité avec le peuple irakien et sa lutte pour recouvrer la souveraineté, appelle toutes les organisations internationales et les institutions qui travaillent à faire respecter le droit international, aussi bien que les parlements nationaux et les organisations régionales, à agir maintenant  et délibérément.

Institutions internationales, organes de surveillance de l'application des traités et parlements  doivent reconnaître la gravité de la situation et agir pour protéger la vie et la personne de tous les civils d’Irak, condamner les politiques US en Irak, exiger le retrait inconditionnel et immédiate de toutes les troupes étrangères, exiger que les États-Unis et toutes les autres puissances occupantes payent des réparations à l’Irak et une compensation aux irakiens pour la destruction humaine et matérielle  provoquée, restaurer pleinement la souveraineté irakienne, reconnaître comme nul et sans effet tout traité, loi ou contrat établi sous occupation, et redonner un semblant de crédibilité aux fondements légaux de la société internationale.

Quand le puissant déclare un état d’exception au droit, les droits et obligations de tous sont sapés. La situation en Irak est une honte pour nous tous. Il est temps maintenant que tous les acteurs en position d’autorité et d’influence redécouvrent leur conscience, aussi bien que leur mandat et leurs obligations légales, défendent  et assurent la fin de cette atrocité.

La ilegalidad estadounidense en Iraq: ¿Dónde está el límite?

La ocupación liderada por Estados Unidos sigue destruyendo con impunidad la legislación humanitaria en Iraq

Los poderes ocupantes han alimentado una cultura de inseguridad que destruye las vidas de los iraquíes de a pié

Las instituciones internacionales, los organismos de control y los parlamentos tienen que actuar o se arriesgan a ser irrelevantes

Han pasado tres años desde que Estados Unidos [EEUU] inició una guerra de agresión ilegal contra la República soberana de Iraq. No se encontraron armas de destrucción masiva ni se ha avanzado ni en la democracia ni en los derechos humanos. Dentro de un mes, los iraquíes iniciarán el cuarto año de ocupación, regidos por un régimen marioneta que apoya los escuadrones de la muerte y la tortura.

Ya ha pasado tiempo suficiente para que esto termine.

En palabras de John Pace – hasta hace poco Coordinador de la Misión de Ayuda Humanitaria de Naciones Unidas [NNUU] en Iraq- "los iraquíes corrientes no tienen absolutamente ninguna protección sea del estado o de las autoridades". Pace añade que "la predominancia de la tortura se ha establecido claramente", [añade] que "el grado de violencia se ha incrementado exponencialmente desde la invasión", y que "se ha barrido al país en términos de estructuras sociales y de su fibra social."

En ausencia de un gobierno iraquí soberano – que no puede existir, por definición, bajo un sistema de ocupación- las fuerzas multinacionales en Iraq lideradas por EEUU son legalmente responsables, e imputables, por la incapacidad de proteger incluso los derechos más básicos de todos los principios de los derechos humanos: el derecho a la vida. La actual situación es intolerable. Solo los trabajadores de la morgue de Bagdad han informado que llegan [a la morgue] una media de 1.600 cadáveres al mes. Tras la destrucción criminal de la mezquita de Al Askari en Samarra, esos mismos trabajadores informan que en un período de unos siete días llegaron 1.300 cadáveres.

La ocupación liderada por EEUU ha llevado, deliberadamente, a Iraq al borde de la desintegración. Están saqueando el país. La tortura y el asesinato son endémicos. Las mujeres y los niños comparten el mismo nivel de violencia. La ocupación no tiene espacio para los detenidos. Las ciudades han sido [convertidas] en objetivos militares y destruidas en un programa de "urbanicidio" – Faluya, Tal Alfar, Al Qaim, Hadiza. Los ataques aéreos estadounidenses y las intervenciones militares de acompañamiento coordinadas son los mayores asesinos en Iraq. De forma reiterada, las encuestas muestran en Iraq que los iraquíes creen que podrían estar más seguros si las tropas extranjeras se van.

Una cultura de destrucción premeditada

Al inicio del año 2006 no tenemos otra conclusión que ofrecer excepto que EEUU ha intentado la destrucción del pueblo de Iraq. El uso de armamento de uranio empobrecido dejará una herida en Iraq durante miles de millones de años. Han destruido todos los servicios públicos – sanidad, agua, electricidad, transporte, justicia y seguridad. La ocupación no ha hecho nada para proteger a los iraquíes. No proteger a los civiles es ya una grave violación de la legislación internacional como lo es el uso criminal de agentes químico – como el fósforo blanco [utilizado] en Faluya y Tal Afar.

La criminal inoperancia, especialmente tras la atrocidad de Samarra – el ejército estadounidense mirando mientras los escuadrones de la muerte pululan por las calles de Iraq – ha iluminado con precisión la manifiesta racionalidad de la presencia de EEUU en Iraq: empobrecimiento del país, ruptura, fomento del odio sectario, atraso y ver cómo los campos yermos consumen a la población. 

El silencio es cómplice

La comunidad internacional ha fallado a Iraq y al pueblo iraquí. Tímidamente se ha tejido una década de silencio respecto a las sanciones criminales al tiempo que EEUU daba el vuelco a un siglo de normas legales y empezaba una guerra preventiva ilegal sobre la base de que [Iraq] ya estaba arrodillado.

El tribunal BRussells, en solidaridad con el pueblo iraquí y su lucha por recuperar la soberanía, apela a todas las organizaciones internacionales e instituciones que trabajan hacia el reestablecimiento de la legalidad internacional así como a los parlamentos y a las organizaciones regionales, para actuar ya en la consecución de este fin. 

Las instituciones internacionales, los cuerpos de control y los parlamentos deben reconocer la gravedad de la situación y actuar para proteger la vida y las personas de todos los civiles de Iraq, condenar las políticas de EEUU en Iraq, exigir la retirada inmediata e incondicional de todas las fuerzas extranjeras, exigir a EEUU y al resto de poderes ocupantes el pago de la reconstrucción a Iraq y la compensación a los iraquíes por la destrucción, humana y material, llevada, restaurar la completa soberanía iraquí, reconocer nulo de pleno derecho cualquier tratado, ley, o contrato aprobado durante la ocupación, y traer nuevamente un ápice de credibilidad a los cimientos de la legalidad en la comunidad internacional.

Cuando el poderoso reclama un estado de excepción a la ley los derechos y obligaciones de todos quedan socavados. La situación en Iraq es una desgracia para todos nosotros. Es hora de que todos los que ostentan posiciones de autoridad e influencia afloren su conciencia, así como su poder y obligaciones legales y se manifiesten asegurando el final, ahora, de esta atrocidad.

Illegale praktijken van de VS in Irak: Waar ligt de grens?

Verklaring van het BRussells Tribunal naar aanleiding van de derde verjaardag van de invasie

 

[De bezetting onder leiding van de Verenigde Staten blijft de mensenrechten in Irak straffeloos vernietigen. De bezettingsmachten hebben een cultuur van onveiligheid gekweekt die de levens van gewone Irakezen verwoest. Internationale instellingen, controleorganen en parlementen moeten handelen of riskeren irrelevant te worden.]

 

Drie jaar zijn voorbij gegaan sinds de Verenigde Staten een illegale,  agressieve oorlog tegen de soevereine staat Irak begonnen. Er werden geen massavernietigingswapens gevonden en de democratie en mensenrechten verbeterden er niet.  Weldra gaan de Irakezen hun vierde jaar in als een volk onder bezetting, geregeerd door een marionettenregime dat doodseskaders en foltering wettigt. De tijd om hier een eind aan te maken werd reeds lang overschreden.

 

Om het met de woorden van John Pace – tot voor kort hoofd van de UN Assistance Mission in Irak – te zeggen: “De gewone Irakees geniet absoluut geen bescherming van de staat of de autoriteiten.”  Pace voegt er aan toe dat “foltering duidelijk tot algemeen gebruik werd”, dat “de graad van geweld exponentieel is toegenomen sedert de invasie” en dat “de maatschappelijke structuren en het maatschappelijk weefsel uiteengereten werden”.

 

Gezien de afwezigheid van een soevereine Iraakse regering – dewelke per definitie niet kan bestaan onder bezetting – zijn de multinationale machten onder leiding van de VS wettelijk verantwoordelijk voor het verzuim zelfs de meest fundamnetele van alle mensenrechten te beschermen: het recht op leven. De huidige situatie is ontoelaatbaar.  Arbeiders in  het lijkenhuis van Bagdad alleen melden een gemiddelde van 1600 lichamen per maand. Na de misdadige verwoesting van de Al-Askari moskee in Samarra rapporteerden dezelfde werknemers 1300 doden voor de periode van zeven dagen.

 

De bezetting onder leiding van de VS heeft Irak bewust tot op de rand van desintegratie gebracht.  Het land werd geplunderd.  Foltering en moord behoren tot de orde van de dag.  Vrouwen en kinderen lijden in dezelfde mate onder het geweld. Onder de bezetting is er een tekort aan ruimte voor de gevangenen. Steden werden in  geprogrammeerde urbicides onder vuur genomen en vernietigd – Fallujah, Tal Afar, Al-Qaim, Haditha. De door de VS gecoördineerde luchtaanvallen en de ermee verbonden militaire interventies zijn de belangrijkste doodsoorzaak in Irak. Herhaaldelijke enquêtes tonen aan dat Irakezen geloven dat ze veiliger zouden zijn indien de buitenlandse troepen vertrokken.

 

Bij de aanvang van het jaar 2006 kunnen we niets anders concluderen dan dat de Verenigde Staten de bedoeling hadden het Iraakse volk te vernietigen. Het gebruik van wapens met verarmd uranium zullen miljarden jaren hun littekens nalaten. Alle openbare diensten zijn ingestort – gezondheid, water, elektriciteit, communicatie, de rechtbanken en de veiligheid.  De bezetters hebben niets gedaan om de bevolking te beschermen. De weigering om burgers te beschermen is een even grote inbreuk tegen het internationaal recht als het gebruik van chemische wapens zoals witte fosfor in Fallujah en Tal Afar. Misdadige passiviteit, vooral na het misdrijf in Samarra – het VS-leger stond erbij toen doodseskaders de straten van Irak afschuimden – heeft heel precies de onderliggende redenering van de aanwezigheid van de VS in Irak benadrukt: het land in armoede storten, het in stukken scheuren, tot sektarische haat aanstoken, aan de kant staan en kijken hoe de killing fields de bevolking verzwelgen.

 

         De internationale gemeenschap heeft Irak en het Iraakse volk teleurgesteld. Meer dan een decennium van zwijgzaamheid over de moordende sancties in combinatie met een schuchtere terughoudendheid toen de Verenigde Staten een eeuw van wettelijke reglementeringen omverwierpen en een illegale pro-actieve oorlog begonnen tegen een staat die reeds op de knieën zat.

 

Het BRussells Tribunal doet, in solidariteit met het Iraakse volk en zijn strijd om de soevereiniteit te herstellen, een oproep aan alle internationale organisaties en instellingen die naar het behoud van het internationaal recht streven. Ook aan nationale en regionale organisaties, om nu en doelbewust te handelen. Internationale organisaties, controleorganen en parlementen moeten de ernst van de situatie erkennen en actie ondernemen om het leven en de persoon van elke Iraakse burger te beschermen.  Ze moeten de politiek van de VS in Irak veroordelen, onvoorwaardelijke en onmiddellijke terugtrekking van alle buitenlandse troepen eisen, van de VS en al de andere bezettingsmachten herstelbetalingen en compensatie vorderen voor de menselijke en materiële schade aan de Irakezen. Ze moeten het volledig herstel van de Iraakse soevereiniteit eisen, elke overeenkomst, wet of contract dat onder de bezetting tot stand kwam nietig verklaren en de wettelijke peilers van de internationale gemeenschap opnieuw enige geloofwaardigheid bezorgen.

 

Wanneer de machtigen een uitzonderingstoestand afkondigen, worden ieders rechten en verplichtingen ondermijnd.  De situatie in Irak is een schande voor ons allen. Het is hoog tijd dat ieder die een gezagspositie bekleedt of invloed kan uitoefenen zijn geweten, evenals zijn mandaat en wettelijke verplichtingen, herontdekt, zich krachtig uitspreekt om een einde te maken deze misdaad.

Aber im Gefolge des Krieges wurden im Irak weder Massenvernichtungswaffen gefunden noch Demokratie und Menschenrechte befördert. In einem Monat gehen die Iraker in ihr viertes Jahr als Volk unter Besatzung, regiert von einem Marionettenregime, das Todesschwadronen und Folter sanktioniert.

 

Es ist längst an der Zeit, dem ein Ende zu machen.

 

In den Worten von John Pace – bis vor kurzem Leiter der UN-Hilfsmission im Irak – „genießt der irakische Durchschnittbürger keinerlei Schutz von Seiten des Staates oder der Behörden.“ Pace fügt hinzu, dass „die allgemeine Verbreitung von Folter klar erwiesen ist“, dass „das Ausmaß von Gewalt seit der Invasion explosionsartig angestiegen ist“ und dass „die sozialen Strukturen und das soziale Gewebe des Landes durch die Invasion in Stücke gerissen worden sind“.

In Abwesenheit einer souveränen irakischen Regierung – die es unter Bedingungen der Besatzung per definitionem gar nicht geben kann – sind die von den USA geführten multinationalen Streitkräfte im Irak (MNF-I) rechtlich verantwortlich und haftbar für den fehlenden Schutz des allerelementarsten, wichtigsten Prinzips der Menschenrechte, des Rechts auf Leben. Die gegenwärtige Situation ist unerträglich. Allein die Angestellten der Leichenhallen in Bagdad berichten von einer durchschnittlichen Anzahl von 1600 Leichen, die jeden Monat dort hingebracht werden. Nach der verbrecherischen Sprengung der Al-Askari-Moschee in Samara berichteten dieselben Angestellten von 1300 Toten in einer Zeitspanne von einer einzigen Woche.

Die US-geführte Besatzung hat den Irak bewusst an den Rand der völligen Desintegration gebracht. Das Land wird geplündert. Folter und politische Morde sind Bestandteil des Alltags. Frauen und Kinder fallen der Gewalt im selben Maß zum Opfer wie Männer. Die Besatzungsmacht weiß nicht mehr, wo sie ihre Gefangenen unterbringen soll. In einem Programm des Urbizids sind ganze Städte angegriffen und zerstört worden – Fallujah, Tel Afar, Al-Qaim, Haditha. US-gelenkte Luftangriffe und die begleitenden militärischen Operationen sind die hauptverantwortlichen Ursachen für die vielen Toten im Irak. Meinungsumfragen im Irak haben wieder und wieder gezeigt, dass die Iraker der Meinung sind, dass sie sicherer wären, wenn die ausländischen Truppen das Land verlassen würden.


Eine Kultur der absichtlichen Zerstörung

 

Zu Beginn des Jahres 2006 können wir keine andere Schlussfolgerung ziehen, als dass die Vereinigten Staaten die irakische Bevölkerung willentlich mit Tod und Zerstörung überzogen hat. Die Verwendung von Waffen mit abgereichertem Uran wird den Irak noch in Milliarden Jahren verfolgen. Sämtliche öffentliche Dienste sind zusammengebrochen – Gesundheitswesen, Wasser- und Stromversorgung, Kommunikations-, Rechts- und Sicherheitswesen. Die Besatzungsmacht hat nichts zum Schutz der irakischen Bevölkerung unternommen. Die Weigerung, die Zivilbevölkerung zu schützen, verstößt ebenso sehr gegen das internationale Recht wie der verbrecherische Einsatz chemischer Kampfstoffe – wie beim Einsatz weißen Phosphors gegen Fallujah und Tel Afar. Diese kriminelle Untätigkeit, besonders nach den Gräueln in Samara – wobei das US-Militär untätig zusieht, wie die Straßen des Irak von Todesschwadronen terrorisiert wird – hat die der US-Präsenz im Irak zugrundeliegende Strategie in ein grelles Schlaglicht gerückt: Sie strebt an, das Land in Armut zu stoßen, es auseinander zu brechen, zu ethnischem und religiösen Hass aufzustacheln und dann untätig zuzusehen, wie die Bevölkerung in einem Meer von Gewalt versinkt.


Wer schweigt, wird mitschuldig

 

Die internationale Gemeinschaft hat gegenüber dem Irak und der irakischen Bevölkerung versagt. Auf ein Jahrzehnt des Schweigens gegenüber den mörderischen Sanktionen folgten nur höchst schüchterne Reaktionen, als die Vereinigten Staaten ein Jahrhundert rechtlicher Regelungen missachteten und einen illegalen präemptiven Krieg gegen einen Staat führten, der bereits völlig wehrlos war.

Das Brussells-Tribunal fordert sämtliche internationale Organisationen und Institutionen, die sich für die Aufrechterhaltung des Völkerrechts einsetzen, die nationalen Parlamente und die verschiedenen Regionalorganisationen zu sofortigem und zielgerichteten Handeln in Solidarität mit der irakischen Bevölkerung und ihrem Kampf zur Wiedergewinnung ihrer Souveränität auf.

Die internationalen Organisationen und Kontrollkörperschaften müssen ebenso wie die nationalen Parlamente den Ernst der Lage erkennen und handeln, um Leib und Leben der irakischen Zivilbevölkerung zu schützen. Sie müssen die US-Politik im Irak verurteilen, den unverzüglichen und bedingungslosen Abzug sämtlicher fremder Truppen fordern und verlangen, dass die USA und sämtliche anderen Besatzungsmächte für die im Irak angerichtete menschliche und materielle Zerstörung Reparationen an den Irak und Entschädigungen an die einzelnen Bürger des Irak bezahlen, die Souveränität des Irak vollständig wiederherstellen, die Nichtigkeit jeglichen unter der Besatzung zustande gekommenen Abkommens, Gesetzes oder Vertrags anerkennen und den rechtlichen Grundlagen der internationalen Gesellschaft wieder einen Anschein von Glaubwürdigkeit und Haltbarkeit zurückgeben.

Wenn die Mächtigen für sich beanspruchen, nicht an das Gesetz gebunden zu sein, richtet sich das gegen die Rechte und Verpflichtungen aller. Die derzeitige Lage im Irak ist eine Schande für uns alle. Es ist für alle, die sich in Positionen von Autorität und Einfluss befinden, an der Zeit, ihr Gewissen wiederzuentdecken, ihrem Mandat und ihren rechtlichen Verpflichtungen nachzukommen und sich laut und öffentlich dafür einzusetzen, dass diesen Gräueln ein Ende gemacht wird.

Appendix: Ein Katalog der Straflosigkeit

Die rechtliche Verantwortlichkeit der Besatzungsmächte im Irak erstreckt sich laut UN-Sicherheitsratsresolution 1637 bis zum 31. Dezember 2006. Als Besatzungsmächte haben die Vereinigten Staaten und die anderen Teilnehmer der MNF-I zahlreiche, im internationalen humanitären Recht, den allgemeinen Menschenrechten und dem internationalen Gewohnheitsrecht niedergelegte Prinzipen und Verpflichtungen verletzt und oftmals systematisch verletzt und/oder sich zu Komplizen solcher Verletzungen gemacht. Einige der solchermaßen verletzten Verträge und Konventionen sind im folgenden aufgeführt:

عـــــــدم شرعـــــــــــية أمريكـــــــا بالعراق : أين النهـايــــة ؟

 

قوات الاحتلال الأمريكية تواصل دكها للقانون الإنساني بفرض حصانتها في العراق

 

قوات الاحتلال تتسبب في عدم الأمان الذي يدمر حياة المدنيين العراقيين

 

يجب على المؤسسات العالمية ، الهيئات الرقابية والبرلمانات أن تتفاعل أو المخاطرة

 

مرت ثلاثة سنوات منذ أن شنت الولايات المتحدة حربها اللاشرعية على سيادة جمهورية العراق. خلالها لم يتم العثور على أسلحة الدمار الشامل ولم يتم أيضاً إرساء حقوق الإنسان و الديمقراطية. يدخل العراقيون عامهم الرابع كشعب محتل  يحكم بواسطة نظام دمى يفرض الموت ،التشرذم  والتعذيب على شعب العراق.

لقد مر الوقت لإنهاء كل هذا.

 

يقول "جون بيس" ، والذي حتى قريباً كان رئيس بعثة الأمم المتحدة بالعراق ، المدنيين العراقيين ليس لديهم أي حماية سواء من قبل الدولة أو من قبل السلطات ". و أضاف "بيس" قائلاً " التعذيب قد ارسي بصورة واضحة" وأن "درجة العنف منذ التدخل قد إذدادت بصورة فادحة" و أن " البلد قد تفتت  فيما يخص التركيبات الاجتماعية والنسيج الاجتماعي".

 

في غياب حكومة عراقية ذات سيادة ، والتي بديهياً لا يمكن أن توجد في ظل الاحتلال ، المسؤولية القانونية تقع على عاتق القوات المتعددة الجنسيات بقيادة أمريكا بالعراق والتي فشلت في ضمان حق أساسي من حقوق الإنسان للعراقيين وهو: الحق في الحياة. الوضع الحالي بالعراق لا يمكن التسامح معه.، العاملين في مشرحة بغداد وحدها قد أدلوا بأن هنالك متوسط 1600 جثة كل شهر. كما صرح هؤلاء العاملين أن هنالك 1300 حالة موت خلال سبعة أيام وذلك تبعاً للتدمير الإجرامي  لجامع الأسكاري بمدينة سمارا .

 

قوات الاحتلال الأمريكي قد قادت العراق بقصد منها إلى الانحدار به للتفتت. العراق قد نهب و أن التعذيب والاغتيالات أصبحت وباء متفشي كما النساء والأطفال على السواء يلاقون نصيب متساوي  من العنف. كما أن هنالك اصبحت أمكنة محدودة للمساجين.

المدن العراقية (فلوجة ، تل عفار ، القييم ، الحديث ) قد  دمرت تحت إطار برنامج  urbicide.

إن التدخل العسكري والقصف الجوي الذي تقوم به أمريكا هو المسبب الرئيسي للقتل بالعراق.  الاستبيانات المتكررة بالعراق  أفصحت عن أن العراقيين يرون أن بلدهم ستكون آمنة إذا خرجت قوات الاحتلال من العراق.

 

ثقافة الدمار المقصود :

مع بداية العام 2006 ليس لنا أي استخلاص نهائي سوى أن أمريكا لها سياسة تدميرية مقصودة لتدمير الشعب العراقي. كما أن استنفاد مادة اليورانيوم سيكون له أثر بعيد المدى يمتد إلى ملايين السنوات. كل الخدمات العامة قد انهارت (صحة، تعليم ،الماء ، الكهرباء ، الاتصالات ، العدالة والأمن ). لم يقم الاحتلال بعمل أي شيء لحماية العراقيين. الرفض لتقديم أي حماية للعراقيين يعتبر انتهاك للقانون الدولي مثله مثل جريمة استخدام الأسلحة الكيميائية  (كاستخدام الفسفور في فلوجة وتل عفار).  سلبية الاحتلال ، بالأخص بعد أحداث خسائر سامرا (القوات الأمريكية يقفون بينما شرذمة الموت يجوبون شوارع العراق) ، كشفت عن هدف أمريكا من وجودها بالعراق :إفقار البلد ، تفتتها ، إفشاء الكره الطائفي ، الوقوف جانباً ومشاهدة الوحوش تبتلع العراقيين.

 

الصمت اشتراك في الجريمة :

المجتمع الدولي قد أفسد العراق والشعب العراقي. عقد من الخوف و الصمت على العقوبات الجرائمية  حيث أن الولايات المتحدة قد أسقطت قرن من النظام القانوني بشنها لحرب غير شرعية على دولة كانت أصلاً تحت قبضتها.

 

تنادي "بروكسل تربيونال" ، و ذلك في إطار تضامنها مع الشعب العراقي ونضاله ضد الاحتلال لاسترداد سيادته ، تنادي  جميع المنظمات والمؤسسات العالمية والتي تعمل لترقية القانون الدولي ، كما تدعو "بروكسل تربيونال"   أيضاً  البرلمانات الوطنية والمنظمات الإقليمية للتفاعل الآن وبهدف واعي.

 

المؤسسات العالمية ، البرلمانات الوطنية والهيئات الرقابية ، جميعها عليها أن تقر بهول الوضع والعمل على حماية حياة المواطنين العراقيين ، إدانة السياسة الأمريكية بالعراق ، المطالبة بالانسحاب الفوري  و الغير مشروط لقوات الاحتلال الأجنبية ،المطالبة بأن تقوم أمريكا و كل قوات الاحتلال بدفع تعويض للعراقيين عن الدمار الإنساني والمادي ، إعادة سيادة العراق كلية ، الإقرار بعدم قانونية أي اتفاقية أو قانون أو عقد أجيز بواسطة الاحتلال ، و بناء قانون  قائم على دعامة سليمة.

عندما يقوم القوي بادعاء  قيام دولة استثنائية ، فإن حقوق و واجبات الجميع تتأثر بشكل سلبي. إن الوضع بالعراق وضع مخزي  للجميع وقد حان الوقت لهؤلاء الفاعلين في مواقع القرار ليختبروا  ضمائرهم  و التزامه القانوني  ، تحدث الآن لتضع حداً لهذا الوضع المخزي.
